Abstract:
The biggest headlines during the first four months of 2011 were generated by the triple tragedy in Japan, which left Tokyo (and much of the rest of the world) shaking, especially over nuclear safety. On the Korean Peninsula, Chinese concerns about the ROK/US “enough is enough” (over?)reaction to North Korean aggressiveness resulted in Beijing's acknowledgment that the road to a solution must run through Seoul, providing a new foundation for a resumption of Six-Party Talks. Meanwhile, elections among the Tibetan diaspora began a long-anticipated political transition, shaking Chinese policy toward the province. More fighting between Thailand and Cambodia over disputed borders has rattled ASEAN as it challenges the most important of its guiding principles – the peaceful resolution of disputes. Economic developments all highlighted growing doubts about the global economic order and the US leadership role. It's easy to predict the biggest headline of the next four month period: "Bin Laden is Dead!" Implications for Asia will be examined in the next issue; initial reactions were predictable.

62. US-Southeast Asia Relations: Dismay at Thai-Cambodian Skirmishes

Abstract:
Both the US and ASEAN expressed dismay at border skirmishes between Thailand and Cambodia around the Preah Vihear temple and two other ancient temples about 160 km to the west. Artillery exchanges and small arms fire call into question the two countries' commitment to the ASEAN rule of the peaceful settlement of disputes among its members. Washington has promised to aid Philippine maritime capabilities to patrol both its South China and Sulu Seas' territorial waters as part of a larger US goal of keeping Asian sea lanes open. New ships and radar installations as well as navy and coast guard training are being provided by the US. In Indonesia, the US embassy inaugurated a new public diplomacy program, @america, an interactive information technology site designed to demonstrate the breadth of American life to Indonesia's tech-savvy young people. Wikileaks releases of US embassy cables published in the Australian press critical of President Yudhoyono caused some tension between Jakarta and Washington. As the current ASEAN chair, Indonesia seemed to follow Secretary of State Clinton's call for an ASEAN role in resolving the South China Sea islands dispute. US relations with Vietnam and Cambodia continue to be strained over human rights concerns. While ASEAN has called for the lifting of economic sanctions on Burma since its recent national election and the release of Aung San Suu Kyi from house arrest, Washington seems in no hurry to follow suit, labeling the election as fatally flawed and noting that political prisoners remain in jail. Finally, the US promised high-level participation in ASEAN-led regional organizations, including the ARF, the ADMM+, APEC, and the EAS.

63. Justice Beyond The Hague: Supporting the Prosecution of International Crimes in National Courts

Abstract:
For nearly two decades, the United Nations has created international criminal tribunals to punish those responsible for war crimes, crimes against humanity, and genocide. Since the early 1990s the United States has strongly supported the UN tribunals for Rwanda and the former Yugoslavia and hybrid UN/national courts for Sierra Leone and Cambodia. The era of court-building culminated in the 1998 adoption, over U.S. objections, of a treaty to establish a permanent International Criminal Court (ICC) in The Hague. These international courts have brought dozens of perpetrators to justice, and the UN Security Council's requests that the ICC investigate the situations in Sudan (2005) and Libya (2011) show that policymakers across the spectrum, in the United States and abroad, believe that accountability-that is, bringing individuals to justice for committing atrocities-can be an important tool to combat war crimes, crimes against humanity, and genocide. Yet as important as these courts are, atrocities occur in places beyond their reach, and even where international courts investigate and prosecute, they lack the capacity to try all but a handful of the thousands of perpetrators of the worst international crimes.

Abstract:
Authorities in belligerent countries are now faced with a new problem: modern warfare and natural disasters. Between 2001 and 2010, four relatively publicized adoption related cases have caused some Third World countries to revitalize their concerns over the rights of children in such cases of adoption, mainly the New Life Children's Refuge (NLCR) in Haiti, the Zoe's Ark in Chad, the Katherine Hart case in Southeast Asian countries, and the twelve United States adoptive parents' case in Cambodia. The thesis of this paper is that there are systemic vulnerabilities and gaps in the current global adoption systems across the Third World Countries, thus creating irregularities and scandals that are predictable to an extent, such as the ones in the four cases under consideration. An investigation will be made as to some of the lessons that can be drawn there from. In the end, this paper concludes by highlighting that, although the four do not hint at the full picture of complications that may arise as a result of global adoption in their corresponding regions, they do, indeed, bear important ramifications, ones that are ignored at the cost of the well-being of children involved.

65. Globalization, Wages, and Working Conditions: A Case Study of Cambodian Garment Factories

We use a comprehensive data set of working conditions and wage compliance in Cambodia's exporting garment factories to explore (1) the impact of foreign ownership on wages and working conditions, (2) whether the relationship between wages and working conditions within these exporting factories more closely resembles efficiency wage or compensating differential theory, and (3) whether the wage-working conditions relationship differs between domestically owned and foreign-owned firms. We find that foreign ownership increases compliance on both wages and working conditions, contradicting the contention that higher wages in foreign-owned firms compensate workers for worse working conditions. In addition, we find a robust positive relationship between wages and working conditions in the sample as a whole, suggesting that efficiency wages or a similar theory more accurately explains the behavior of these exporting firms than compensating differentials.

66. Better Factories Cambodia: An Instrument for Improving Industrial Relations in a Transnational Context

Globalization of production has created an environment for labor-management relations that involves international actors and spans countries, going beyond the boundaries of the traditional workspace. The dramatic changes brought about by globalization led to the emergence of new cross-border forms of industrial relations. This paper analyses the case of the International Labour Organization's Better Factories Cambodia (BFC) project as a transnational instrument to create the institutional space for industrial relations in Cambodia. Based on the principle of social dialogue among the social partners (the national Government and workers' and employers' organizations) as well as with global buyers, BFC's multistakeholder approach reaches beyond the workplace and may be a key instrument of industrial relations because it bridges the gap between the sphere of production and that of consumption. The empirical results reveal some of the particular strengths of the program.

The field of international criminal law (ICL) is synonymous with the crowded courtroom and the infamous individual in the dock; Adolf Eichmann, Slobodan Milošević, Saddam Hussein, and now Radovan Karadžić. The actions of such individuals have taken place within the various conflicts and mass atrocities that have proven to be lamentably frequent both during the last century and now into this one. In the aftermath of this sustained bloodshed, trials, whether national (Klaus Barbie in France, John Demjanjuk in Germany) or international (Jean Kambanda before the International Criminal Tribunal for Rwanda (ICTR)), have constituted a frequent (David Scheffer's pronouncement of 'tribunal fatigue' suggests perhaps too frequent) reflex reaction by states and have formed the backbone of ICL. Beginning with the Leipzig trials, then via Nuremberg and Tokyo, Yugoslavia and Rwanda to the creation of the International Criminal Court (ICC), successive tribunals have sought to build upon the strengths (and weaknesses) of their predecessors. For example, the recent rise of hybrid courts such as the Special Tribunal for Lebanon and Extraordinary Chambers in the Courts of Cambodia (ECCC) can be attributed, at least in large part, to the flaws of previous international judicial institutions; a perceived lack of legitimacy, huge running costs, and detachment from victims, communities, and the locus delicti. The evolution of ICL thus proceeds through a series of trials and error.

68. Politics by other means? The virtual trials of the Khmer Rouge tribunal

This article argues that more emphasis should be placed on the political aspects of international tribunals, which are often in the business of reshaping politics as well as simply administering justice. By examining the hybrid Extraordinary Chambers in the Courts of Cambodia (ECCC), popularly known as the Khmer Rouge Tribunal, the article develops arguments previously advanced by Victor Peskin in respect of Rwanda and the former Yuogoslavia. Peskin has suggested that courtroom war crimes trials are paralleled by 'virtual trials', in which international and domestic political actors struggle for power and control over the form and outcome of proceedings. The Cambodian case demonstrates that where war crimes tribunals are concerned, backroom 'virtual trials' need as much academic, policy and media attention as the actual courtroom trials of key defendants.

69. Deep in South China Sea Diplomacy

Diplomacy related to the South China Sea disputes dominated US actions at the May ASEAN Summit, the June Shangri-La Dialogue, and the July ARF meeting. Washington endorsed ASEAN consultations before the Association's meetings with China on the territorial disputes as well as an independent ASEAN role in the South China Sea negotiations separate from the bilateral negotiations preferred by the PRC. Related to US support for ASEAN is Washington's assistance to the Philippines in gradually building its archipelagic security capability by funding Coast Watch South radars and promising more military hardware to the ill-equipped and underfunded Philippine armed forces. Manila also maintained its efforts to obtain a specific defense commitment from the US in the event of a military conflict with China over South China Sea islands. The Cambodia-Thai border dispute continues to flare periodically. ASEAN mediation efforts have established a timetable for military disengagement but, as yet, no implementation. Washington has endorsed the ASEAN efforts. In Indonesia, radical Jemaah Islamiyah, al Qaeda-affiliated cleric Abu Bakar Bashir was sentenced to 15 years in jail for aiding the formation of a new terrorist affiliate in Aceh. As in his previous trials, Bashir blamed his arrest and sentence on US and Jewish machinations. Although the Obama administration has appointed a new envoy, Derek Mitchell, as special ambassador to coordinate international approaches to Burma, this enhanced engagement runs parallel to increased US economic sanctions, suggesting little has changed with the new “civilianized” government.

Abstract:
Research capacity development at the higher education level in order to improve environmental planning and management has been considered invaluable in ensuring the sustainable development of developing countries. In least developed countries (LDCs), such as Cambodia, people are especially vulnerable to environmental changes and advanced knowledge is urgently needed to enhance their socio-ecological resilience; however, governments lack both the financial and human resources needed to ensure adequate academic infrastructure for knowledge generation and dissemination. Furthermore, the international aid community has rarely placed emphasis on investing in higher education in developing countries; instead, producing basically skilled labourers through primary and secondary education was considered more effective in bringing return on investment and enhancing economic development. Neither national nor international development agendas have so far resulted in a substantial commitment to research capacity development of academic institutions in LDCs.
