111. Greek FDI in the Balkans: How is it affected by the crisis in Greece?

Abstract:
The current Greek crisis raises the question of its impact on foreign direct investment (FDI) by Greece on its neighbors in the Balkans. Greek multinational enterprises (MNEs) first began to establish a presence there in the 1990s, following the breakup of the former Yugoslavia. This trend accelerated during the past decade. As of 2009, Greece's outward FDI stock in the Balkans stood at US$ 10.5 billion or 26.5% of Greece's outward FDI stock worldwide.

Abstract:
With the fall of centrally planned economies in the Balkans, their liberalization and the opening of their borders to free trade and capital movements, Greece became more active in the generation of outward foreign direct investment (OFDI). Greece's OFDI stock increased from US$ 3 billion in 1990 to US$ 6 billion in 2000 and to US$ 38 billion in 2010. The Europeanization process of Turkey and the transition of the economies in the Balkans was accompanied by a gradual rise of FDI from Greece into those economies. More than half of Greece's OFDI stock – over US$ 20 billion in 2009 (67% of total) – is located in South-East Europe: in the Balkans, Cyprus and Turkey. While Greece's early OFDI flows were directed to the secondary sector to reduce costs, the bulk of later flows was directed to the services sector, as new markets were opened. This shift signifies the rise of major corporate players. The Greek Balkan policy, which commenced through the European Union, and the upgrading of the Athens Stock Exchange have positively affected Greece's position as a key regional investor. The expectations for sustaining this leading role, however, have been weakened recently since, due to the Greek sovereign debt crisis, Greek multinational enterprises (MNEs) disinvested US$ 1.6 billion from their FDI abroad in 2010.

113. Bosnia: Europe's Time to Act

Abstract:
After years of hesitancy, European Union (EU) member states should make 2011 the year when the lead international role in Bosnia and Herzegovina shifts from the Office of the High Representative (OHR) to a reinforced EU delegation. Bosnia has outgrown the OHR established in 1995 after the Dayton Peace Agreement and the creation of the Peace Implementation Council (PIC). Today the country needs EU technical assistance and political guidance to become a credible candidate for EU membership, not an international overseer to legislate for it or maintain security. Member states should rapidly install a comprehensive plan to reinforce the EU presence, including an embassy led by a strong ambassador, strengthen the membership perspective and build local credibility. OHR should withdraw from domestic politics and, unless a threat to peace emerges, focus on reviewing past decisions.

114. Slippery Slope: Libya and the Lessons of Previous No-Fly Zones

Twenty years ago, at the close of the 1991 Gulf War, the imposition of a UN-mandated no-fly zone contributed to the formation of a safe haven for Iraqi Kurds, resulting in the liberation of nearly three million people from Baathist dictatorship a full decade before the rest of Iraq. In 1992, new UN-mandated no-fly and no-drive zones were established in southern Iraq and the Balkans to contain rogue regimes and protect civilians from government repression. Given the current developments in Libya, it is natural to consider employing such options once again. Yet history shows that exclusion zones are particularly tricky operations. If not configured properly, they can be worse than useless, signaling fecklessness instead of resolve while providing little real protective value to civilians.

Progress has been lacking for more than three years in the peace-building process, since the Bosnian and Herzegovine (BiH) parliament failed in April 2006 to decide on a new constitution which would make "Dayton-Bosnia" a more viable state, with rational institutions compatible with future EU and NATO membership. As a consequence, BiH remains a dysfunctional state, with frequently blocked decision-making mechanisms, nationalistic rhetoric and policies, as well as a lack of cross-entity and cross-ethnic cooperation.?

116. Kosovo and Serbia after the ICJ Opinion

Abstract:
In the wake of the July 2010 International Court of Justice (ICJ) advisory opinion on the legality of Kosovo's declaration of independence, Kosovo and Serbia have an opportunity to resolve differences, establish bilateral relations and unblock their paths to greater European Union (EU) integration. The obstacles are formidable, including mutual suspicion, incompatible agendas and uncertainties about the true goals of each. Failure to negotiate in the next months would probably freeze the conflict for several years, as the parties entered electoral cycles, during which the dispute would likely be used to mobilise nationalist opinion and deflect criticism of domestic corruption and government failures. Enough has changed recently, especially the development of more realistic if not yet fully public attitudes in Belgrade and Pristina, to suggest a win-win solution is possible. Without preconditions and facilitated in particular by the EU, Kosovo and Serbia should promptly open talks with the aim of reaching as comprehensive a compromise settlement as possible.

Abstract:
Following the establishment of the international ad hoc tribunals, the International Criminal Tribunals for the Former Yugoslavia and Rwanda (ICTY and ICTR respectively), a new model of justice administration emerged at the end of the 1990s through the development of hybrid or internationalised courts. Hybrid tribunals are conceived as a mixture of international and domestic law and staff, as a way to provide the necessary resources and guarantees for justice closer to those whose work matters to most. They have different compositions and legal frameworks depending on the context of the country. The first ones were established in Kosovo, Timor Leste and Sierra Leone These first hybrid mechanisms were seen as a new experiment for international justice.

118. Federation of Bosnia And Herzegovina – A Parallel Crisis

The Federation of Bosnia and Herzegovina (FBiH), the larger of Bosnia and Herzegovina's two entities, is in crisis. Disputes among and between Bosniak and Croat leaders and a dysfunctional administrative system have paralysed decision-making, put the entity on the verge of bankruptcy and triggered social unrest. Much focus has been on the conflict that pits the Serb-dominated Republika Srpska (RS) against the Federation, but the parallel crisis within the Federation also deserves attention. The need for overhaul of the FBiH has been ignored because of belief that state-wide constitutional reform would solve most of its problems, but any state-level reform seems far off. Bosnia's challenges all have echoes at Federation level, though in simpler form. Reform in the Federation, starting with establishment of a parliamentary commission, is achievable and could give impetus to state-level reform, while improving the livelihoods of the people in Bosnia's larger entity. If it does not happen, Bosnia, which was wracked by three and a half years of war in the 1990s, may well slide toward new political and economic ungovernability.

119. The ICJ's Advisory Opinion on Kosovo

Abstract:
On July 22, 2010, the International Court of Justice (ICJ) issued its advisory opinion on Kosovo's declaration of independence of February 17, 2008, observing that the declaration was not in violation of international law. The Court's opinion may facilitate further recognitions of Kosovo but thus far there has been no significant increase in the number of countries extending recognition. Although the Court's opinion was drafted with the specific and unique circumstances of the Kosovo case in mind, it has been followed with interest by separatist parties engaged in contested territorial struggles elsewhere around the world. Separatists are likely also to be watching with interest the next steps that may be taken with regard to Kosovo in the wake of the ICJ's advisory opinion, especially any boundary adjustments that may be proposed and agreed upon between the Serbian and Kosovar governments.

Abstract:
The subject of learning lessons is fraught with difficulties, not least because lessons, like beauty, are often in the eye of the beholder. It has been the author's experience that many lessons that are formally identified as such are not learned. The reasons for this are varied: those identifying the lessons may be biased; the resources to enable learning may be lacking; and the lessons simply may not "stick." Nonetheless, those lessons that do become embedded in the human and organizational psyche are those that have created new doctrines, reshaped institutions, become an integral part of new training standards, and demonstrably shown an improvement in the conduct of business.
