Abstract:
The declaration of independence of Kosovo on February 17 th , 2008 has marked the last stage of Kosovo's path to state building and also has closed the last chapter on the disintegration of Yugoslavia. The declaration of independence and the subsequent enacting of the Constitution by the Assembly of the Republic of Kosovo were not annulled by United Nations Mission in Kosovo (UNMIK). Therefore, the legality of this act was quietly accepted by UNMIK, despite the lack of agreement within United Nations Security Council (UNSC). In addition, a day before the independence was declared, the EU Special Representative for Common Foreign and Security Policy Dr. Javier Solana, appointed Mr. Peter Feith as the Head of International Civilian Office (ICO) and the Council of European Union decided to deploy the EULEX Mission to Kosovo as envisaged by the Ahtisaari's Comprehensive Status Proposal.

Abstract:
A month has passed since Kosovo declared independence on 17 February 2008. Much has gone well, but there is a real risk, as made most evident with the violence on 17 March around the courthouse in north Mitrovica, that partition will harden at the Ibar River in the north, and Kosovo will become another frozen conflict. To seek to prevent this, more countries must recognise and embrace the new state, the international missions (European Union and NATO) must be more proactive and coordinate their operations and, most importantly, it must be demonstrated to Serbia, supported by Russia, that it will not be permitted to break up the new state.

The preferred strategy of the European Union (EU) and the U.S. to bring Kosovo to supervised independence through the United Nations Security Council has failed, following Russia's declared intention to veto. With Kosovo Albanians increasingly restive and likely soon to declare unilateral independence in the absence of a credible alternative, Europe risks a new bloody and destabilising conflict. To avoid chaos on its doorstep, the EU and its member states must now accept the primary responsibility for bringing Kosovo to supervised independence.

At the end of the NATO/Yugoslavia war almost eight years ago, the Albanian-majority Serbian province of Kosovo was removed from Serbia's governance and placed temporarily under a United Nations protectorate, administered by the UN Mission in Kosovo (UNMIK). Last summer, UN Special Envoy Martti Ahtisaari was tasked by the Security Council with resolving the question of Kosovo's future status, with support from U.S. and European Union envoys (Frank Wisner and Stefan Lehne respectively). Ahtisaari's effort is now drawing to a close. He has delivered to both Pristina and Belgrade a plan that explicitly allows a great deal of protection for Serbs and their religious monuments in Kosovo but implicitly ends Belgrade's sovereignty. His plan opens the prospect of a sovereign and independent Kosovo under continuing international supervision. It is anticipated that Ahtisaari will take his plan, with some revisions, to the UN Security Council this month. This USIPeace Briefing discusses potential drivers of conflict in Kosovo during the status decision and in the period thereafter. These drivers of conflict arise from the international community, the Kosovo Albanians, Serbia and the Kosovo Serbs. They have the potential not only to make Kosovo dysfunctional but also to destabilize the region.

More than 15 years after the end of the Cold War, it is clearer than ever that the 'New World Order' has failed to bring about eternal peace, and that we are nowhere near the 'end of history'. Southern Serbia's Albanian-majority Presevo Valley is a still incomplete Balkan success story. Since international and Serbian government diplomacy resolved an ethnic Albanian insurgency in 2001, donors and Belgrade have invested significant resources to undo a legacy of human rights violations and improve the economy. Tensions are much decreased, major human rights violations have ended, the army and police are more sensitive to Albanian concerns and there is progress, though hesitant, in other areas, such as a multi-ethnic police force, gradual integration of the judiciary, and Albanian language textbooks. Ethnic Albanians appear increasingly intent on developing their own political identity inside Serbia and finding a way to cohabit with Serbs, something that should be encouraged and supported. Nevertheless, the Kosovo status process threatens to disrupt the Presevo Valley's calm.
