Abstract:: In order to assess whether the Arctic region is evolving into a region of cooperation or one of confrontation, a thorough understanding of the existing (and evolving) bilateral, regional and international institutional frameworks with relevant regulations for the Arctic and their adequacy for solving possible controversies is paramount. Disputes can flare up over various issues, as the Arctic has aptly demonstrated in recent years. Whether these disputes erupt into conflict or are handled cooperatively depends significantly on the rules and regulations that parties have put in place. While most of the literature deals with resource ownership, it is argued here that the more significant potential sources of controversy between Arctic states are issues of responsibility, liability, precaution and preparedness concerning possible transboundary environmental risks and dangers and, generally, protection of the fragile Arctic ecosystem.

Abstract:: In light of the ongoing discussion on the expert and scholarly level regarding the kind of regulatory regime for international relations that should be formed in the arctic – national (sectoral), regional or international, broad to the maximum degree possible – it is important to revisit the text of what is known as the Ilulissat Declaration, signed by the five arctic states in May 2008. It is of primary importance that the Declaration records the provision that an “extensive international legal framework” should be applied to the arctic ocean. The Declaration defines this “framework” as the law of the sea, which provides for important rights and obligations concerning the use and exploitation of the resources and spaces of this marine region. The law of the sea is regarded as a solid foundation for “responsible management” in the arctic. What is the significance of these formulations, what meaning did the authors of the Declaration assign to them, and what interpretations are possible here – these matters are considered in the present analytical overview.

Abstract:: This paper concerns the US view of East Asian nations' involvement in the Arctic, emphasizing the perspective of Alaska, the only US Arctic state. It treats six different areas of US/Alaska policy: US national strategy for the Arctic; oil and gas exploration and development; marine transportation; fisheries; investment in infrastructure; and governance. The study finds few differences between the positions of Alaska and the United States, notwithstanding often-hostile rhetoric from leaders in the United States' farthest north frontier. In general terms, both Alaska and the United States have historically sought trade and investment ties with East Asian nations. China has now replaced Japan as Alaska's major trading partner, followed by South Korea and Taiwan.

Abstract:: The gradual retreat of polar sea ice, combined with an expected increase in human activity-shipping traffic, oil and gas exploration, and tourism in the Arctic region-could eventually increase the need for a U.S. military and homeland security presence in the Arctic. As a result, the Department of Defense (DOD) must begin preparing to access, operate, and protect national interests there. House Report 111-491 directed DOD to prepare a report on Arctic Operations and the Northwest Passage, and specified five reporting elements that should be addressed. House Report 112-78 directed GAO to review DOD's report. GAO assessed the extent to which 1) DOD's Report to Congress on Arctic Operations and the Northwest Passage (Arctic Report) addressed the specified reporting elements and 2) DOD has efforts under way to identify and prioritize the capabilities needed to meet national security objectives in the Arctic. GAO analyzed DOD's Arctic Report and related documents and interviewed DOD and U.S. Coast Guard officials.
