Abstract:
The integration of Central America's fragmented electricity market has always seemed a no-brainer—at least to outsiders. A seamless grid for delivery of electricity would not only make regional power generation projects affordable, but would also reduce costs to consumers and governments alike, as well as strengthen energy security at the national level. The foundations for a robust regional electricity market were, in fact, laid by a regional treaty in 1996, establishing the Sistema de Interconexión Eléctrica de los Países de América Central (Central American Electrical Interconnection System—SIEPAC), which aimed to knit together the electrical grids from all six countries. But the original target completion date of 2008 was not met. Although several key pieces of the regional market are under development, the plan has fallen victim to regulatory bottlenecks and the shifting political priorities of individual governments. The unfortunate result: Central America's electricity markets remain mostly within national boundaries.

Abstract:
The Inter-American System enshrined the right to freedom of thought and expression in Article 13 of the American Convention on Human Rights and Article IV of the American Declaration of the Rights and Duties of Man. In 1998, to further protect this right, the Inter-American Commission on Human Rights (IACHR or the Commission) established the Office of the Special Rapporteur for Freedom of Expression. I served as the first head of the office.

274. The Flawed Strategic Debate on Syria

Abstract:
Dating from Bashar al-Asad's first suppression of mass demonstrations in April 2011, the war in Syria is now 3 years old, has killed more than 130,000 Syrians, and displaced nine million Syrians, two million as refugees into neighboring countries. Foreign intervention has increasingly shaped the course of the fighting and will continue to have substantial regional consequences. The complexity of this bitter, nominally internal struggle has dampened American enthusiasm for joining the fray or even paying much attention to Syria, notwithstanding the chemical weapon attacks on Gouta, east of Damascus, last August, which captured the attention of the American people, media, and policy community. With an international taboo broken and a Presidential redline crossed, public debate spiked in August-September 2013 over U.S. interests in Syria and the limits on what we will do to secure them. Debate did not result in a consensus for action.

In an interview with Reuters on 17 October 2013, Professor Joseph Nye commented on the global impact of the government shutdown in Washington: "It's clearly very damaging for American soft power in the sense that the reputation for effective management of government and of the world's reserve currency are hurt". On the same day, President Obama echoed this interpretation: "Probably nothing has done more damage to America's credibility in the world, our standing with other countries, than the spectacle that we've seen these past several weeks".

After all, federal entitlement programs make up well over half of federal spending today and account for all projected growth in noninterest outlays as a share of GDP over the next three decades.

Abstract:
While NAFTA itself does not contain any provisions for governance transfer, its two side agreements (NAALC, NAAEC) prescribe standards in the realm of human rights (labor, environment), the rule of law, and good governance and create a number of instruments for their (indirect) promotion. Through technical assistance, fora for dialogue and exchange, monitoring, and complaints procedures that can result in monetary sanctions, the side agreements aim at promoting the effective enforcement of national law rather than regional standards. These provisions reflect the same concerns in the United States and Canada that lead to the conclusion of the two side agreements in the first place: creating conditions for fair competition in light of Mexico's failure to effectively enforce national laws, resulting in de facto lower labor and environmental standards and thus lower costs compared to the northern neighbours. Beyond formal governance transfer, NAFTA has had an impact on domestic governance reforms in Mexico since the early 1990s as it was used as leverage in both international negotiations and Mexican domestic politics.

278. Governance Transfer by the Organization of American States (OAS)

Abstract:
This case study examines to which extent the Organization of American States (OAS) engages in governance transfer to its member states. Both the standards and policies prescribed in regional documents as well as their application are analyzed. Historically, the organization has emphasized two areas. Human rights are protected through multiple treaties and a strong regional legal regime. Democracy is protected by strong incentives to avoid coups and supported via different types of assistance, including a long-standing system of election observation. The OAS addresses good governance since the 1990s, particularly with regard to combating corruption and modernizing public management. Provisions concerning the rule of law are addressed in connection with the other standards. After analyzing the framework and measures of governance transfer, this report explores how the observed patterns can be explained and briefly discusses the future prospects for the OAS.

La homeland security, mise en place aux États-Unis après les attentats du 11 septembre 2001, incarne la transformation contemporaine de la sécurité. Son apparition n'est pas directement liée à la chute du World Trade Center mais relève plutôt d'une dynamique de sécurité qui s'est cristallisée au milieu des années 1990. Cette dynamique repose sur la conjonction de cinq processus : la formation d'un consensus autour de la promotion d'une Amérique forte et vigilante (processus ontologique), un changement des pratiques stratégiques tournées vers la réduction des vulnérabilités (processus stratégique), la création d'un espace bureaucratique de sécurité situé au-delà du militaire et du policier (processus bureaucratique), l'avènement de nouveaux acteurs de la sécurité spécialisés dans la gestion des risques (processus sociologique), la prégnance d'une appréhension de l'innovation technologique comme source de la menace et remède face à celle-ci (processus technologique).

280. On Rights to Land, Expulsions, and Corrective Justice

Abstract:
This article examines the nature of the wrongs that are inflicted on individuals and groups who have been expelled from the land that they previously occupied, and asks what they might consequently be owed as a matter of corrective justice. Such cases-in which individuals and groups are expelled, their property is expropriated, and their land is subsequently settled by other people-are not unusual. They include the expulsion of Germans from the Sudeten area of Czechoslovakia between 1945 and 1947; the expulsion of (mainly) Greek Cypriots from the north of Cyprus following the Turkish invasion there in 1974; and the expulsion of Muslim Bosniaks from what is now called the Republic of Srpska, in Bosnia-Herzegovina, between 1991 and 1995. Historically, there are numerous other cases of "ethnic cleansing" and border redrawing. The injustice with which this article is concerned is also foundational to the current dominant societies in the Americas and Australasia.
