1. Together or Alone? Policy Brief The need for increased Albanian-Dutch cooperation to fight transnational organised crime

Abstract:
In recent years the Netherlands has voiced security-related concerns about the involvement of Albanians nationals in organised crime in the Netherlands. These concerns culminated in a request to the European Commission to suspend visa-free travel for Albanians to the EU. This policy brief argues that the current Dutch approach does not provide the best means to address issues of organised crime, such as drug trafficking, related to Albanian nationals. It identifies several inadequacies in the crime data used to substantiate the Dutch position and the way Dutch authorities publicly communicate them. It posits that greater bilateral cooperation beyond the EU accession framework could improve efforts to fight transnational organised crime effectively. The opening of EU accession negotiations with Albania may offer a window of opportunity to formulate a constructive agenda of cooperation beyond the formal EU enlargement framework. Abstract:
Parliamentary oversight refers to the ongoing1 monitoring, review, evaluation and investigation of the activity of government and public agencies, including the implementation of policy, legislation and the expenditure of the state budget. Parliamentary oversight is one of the most important manifestations of the separations of powers in a democracy. Parliamentary oversight must extend to all areas of government, including intelligence and security services. Intelligence services work in secrecy and have the authority to make use of special powers that potentially are highly invasive of human rights. Communications interception and secret surveillance are only two of such powers. For these reasons, intelligence services are regarded by the public with suspicion and lack of confidence. Therefore, the need for legality, legitimacy and accountability is even higher for intelligence services than for other government agencies. As the lawmaker, parliament is responsible for enacting clear, accessible and comprehensive legislation establishing intelligence services, their organisation, special powers and limits. Parliamentary oversight activities review, evaluate and investigate how laws are implemented and how intelligence operations are in line with the constitution, national security policy and legislation. Parliament also approves the budget of intelligence services and can play a strong role in scrutinizing expenditure. Effective parliamentary oversight ensures a bridge between intelligence and the public and brings benefits to all: intelligence community, parliament itself and most importantly, the citizens.

Abstract:
Why and how should private security be regulated? A group of researchers from Albania, Bulgaria, Kosovo, Serbia and Switzerland has been examining these questions as part of a multi-year project called the Private Security Research Collaboration Southeast Europe (“PSRC”) 1 . The interest of the state in interfering with the activities of private security companies is twofold: first, to ensure that basic pillars of the modern democratic state such as the protection of human rights and the democratic order are not threatened. Second, because the stability of the state and the happiness and prosperity of its citizens also depend on factors such as functioning security and economy. In order to better target its regulation of private security, it would therefore be important for the state to know how private security companies (PSCs) impact on a country’s human rights situation, the democratic order, a functioning security and (to a lesser extent) economy. For Private Security in Practice: Case studies from Southeast Europe the PSRC researchers assembled eight case studies that explore the impact that private security has on security, human rights and the democratic order in four Southeast European countries: Albania, Bulgaria, Kosovo and Serbia. Since regulation should not only limit the negative impact but also foster the positive contribution that private security can make, the authors specifically looked at how challenges posed by PSCs could be avoided and how opportunities can be seized.

Abstract:
On 01 November 2006, an initial exploratory meeting for a Western Balkans Members of Parliaments took place in Belgrade. The meeting was organised by SEESAC with the assistance of the Parliamentary Forum on Small Arms based in Sweden. Members of the European and EU member states' Parliaments, the Secretary General of the Parliamentary Forum for SALW, and UNDP technical advisors and project managers informed the parliamentarians from the Western Balkans about EU SALW strategies and engagement, the involvement of EU parliamentarians in SALW Control, the importance of a national SALW control strategy, and the need for co-ordinated action and increased parliamentary diplomacy, oversight and advocacy.

Abstract:
America's unique position of power in the post-Cold War era has often inspired comparisons to that of Rome during the rule of Augustus. But the security policy adopted by the United States, especially since the 9/11 attacks, calls to mind a different ancient place and personage: Pyrrhus (318 - 272 B.C.E.), king of Epirus, a Hellenistic realm that comprised what is now northwestern Greece and southern Albania. Plutarch memorializes Pyrrhus as a “great man of war” – but also a fool. Although he waged successful campaigns against Macedonia, the Romans, and others, Pyrrhus was unable to preserve his gains, which came at great cost. In the end, his martial ambitions won him and his kingdom nothing but ruin and disapprobation. He is remembered today in the phrase “Pyrrhic victory”– meaning any victory not worth its cost.

There is growing concern that the short postponement UN Special Envoy Martti Ahtisaari announced in November 2006 for presentation of his Kosovo final status proposals to take account of Serbia's 21 January elections may not be the last delay in a process that now could extend into the second half of 2007. Nervous Kosovo Albanian leaders worry they may not be able to contain public pressures beyond March. With Russia's position hardening and Serbia as obstinate as ever, EU unity is vital – but far from assured – to keep the status process on track, first in the small Contact Group that has managed Kosovo affairs since 1999, then in the Security Council where ultimate decisions should be made.

Abstract:
This report will first describe the present status of Kosovo, and then review relevant considerations of its future status, on the one hand focussing on international law – the de jure status, and on the other hand focussing on sustainability – the de facto stat us. This approach of de jure versus de facto is primarily an analytical tool, chosen because it sheds light on a number of considerations relevant to the negotiation process that will determine the future status of Kosovo. Second, this approach reflects the fact that while the Kosovo Albanian s want maximum self-determination, they realize that they are dependent on international assistance. In contrast, the Serbs believe that international legal considerations of a conservative or conservationist nature are essential, but they admit that they cannot take responsibility for Kosovo's security or economy. To put it briefly, the Albanians want independence de jure but not de facto, while the Serbs want independence de facto but not de jure.

The Stabilization and Association Process (SAP) was initiated by the EU for countries not covered by European agreements, i.e. Albania, Bosnia and Herzegovina, Croatia, Macedonia and Serbia and Montenegro. The process is realized through Stabilization and Association Agreements (S AA) that the EU already concluded with Croatia and Macedonia, which have important implications for international trade and investment. The SAAs focus on respect for democratic principles and strengthening links of the countries of the region with the single market. They foresee the establishment of a free trade area with the EU and set out rights and obligations in areas such as competition and state aid rules, intellectual property and rights of establishment, which will allow the economies of the region to begin to integrate with the EU. Therefore, the SAP should be regarded as a tool for integration of the countries of South-East Europe into the emerging pan-European free trade area, resulting in removals of trade barriers between all countries that are gaining associate membership status. It should be regarded as a process of transformation of small, closed national economies to countries integrated in a wide area of free movement of goods, services and investment.

10. Labour Markets and Employment Development in South East Europe

Abstract:
In contrast to the Central European transition countries, the economies of South East Europe (SEE) have been facing complex and interrelated political and economic problems. The dis solution of Yugoslavia combined with market losses, war in Bosnia and Herzegovina and Croatia, sanctions finally culminating in the Kosovo conflict were the main causes of political and economic instability in the whole region. Taking into account these factors, output recovery has been much slower in SEE than in the Central European countries. Measured in purchasing power standards, Croatia is the best per former in the region, with its GDP at about 38% of the EU average. Next comes Bulgaria (32%), whereas the respective values f or Serbia and Montenegro and Albania range between 15-17%. Looking at the economic performance in the 1990-2002 period, Croatia and Romania reached almost 94% of their pre-transitional level in 2002, followed by Bulgaria and Macedonia (about 88% each). Serbia and Montenegro, the worst-affected, reached only about half of what it was in 1990. The cumulative output decline there was one of the largest among all the Central and East European countries.
