41. State Responses to the Relapse into Insurgent Violence in Nigeria's Oil Region

With its roots in decades of crude oil production and the attendant crises of mismanagement of oil revenues, the reemergence of armed groups1 in the Niger Delta region in early 2016 marked a return to the ‘business-as-usual’ insurgency that dominated the oil region since the 1990s. In February 2016, the Niger Delta Avengers (NDA) claimed responsibility for attacking oil facilities owned by major international oil companies (IOCs). During the same period, the state-owned Nigeria National Petroleum Com- pany (NNPC) reportedly spent N4.023 billion to repair 293 pipeline breaks. These attacks disrupted oil production and forced the IOCs to declare a force majeure, reducing daily oil production from 2.2 million to between 1.6 and 1.7 per million barrels per day. These developments coincided with a na- tional fiscal crisis linked to dwindling global oil prices; from over $100/barrel to around $50/barrel. Without steady gas supplies, the already dire electricity situation nationwide was further compounded by a 2,500 megawatts drop in power generation.

42. Corridors of trade and power: economy and state formation in Somali East Africa

Abstract:
Despite ongoing conflicts, Somalia’s economy has evolved considerably since the disintegration of the central state in 1991. However, our knowledge and understanding of how transnational Somali economic life is organised and how it influences political dynamics remains limited. As part of the research programme “Governing Economic Hubs and Flows in Somali East Africa” (GOVSEA) this working paper provides an overview of the existing literature on the subject. This paper presents a summary analysis of key features of the Somali economy and proposes a periodisation of the evolution of Somali business between 1991 and today: from the heavily informalised economy of the 1980s, the violent markets of the early 1990s and the subsequent ‘duty-free shop’ period, to the emergence of a more regulated economy with a significant development of multi-clan shareholder companies since the mid-2000s. In doing so, this paper offers numerous empirical and analytical insights into the relationship between trade, violence and regulation. With ongoing and future research on this topic in mind, we suggest a series of research questions and conceptualise the nexus between everyday economic activities and state formation dynamics. Finally, we propose a ‘corridor approach’, focussing on transnational corridors of trade and transport that traverse Somali East Africa, as a way of grasping the complex and dynamic interactions between state formation and everyday economic activity.

Abstract:
The International Criminal Court (ICC) commenced investigation of the armed conflict in Uganda in 2004. In 2005 it issued arrest warrants for five leaders of the Lord’s Resistance Army (LRA). This article examines how the court’s involvement in the situation has impacted on conflict transformation in Uganda after ten years of judicial work. It also addresses the problem of assessing the impact of law on conflict through the use of an analytical framework that is based on four variables: deterrence, victims’ rights, reconciliation, and accountability to the law. Relying on this framework, and on a report of a field research project in Uganda, it argues that the ICC’s intervention has had multiple impacts on the situation in Uganda, and that despite some arguments to the contrary, the ICC does promote conflict transformation through deterrence, promotion of accountability to the law and promotion of victims’ rights.

The CTC is pleased to launch the publication of papers as part of a series devoted to the study of jihadist biographies. The purpose of this project is to contribute to the knowledge of the evolution of the jihadist landscape by exploring it through the lens of the worldviews and experiences of actors who have shaped it. While some states and organizations, wittingly or unwittingly, contributed to the growth of the jihadist enterprise, it may be argued that modern jihadism, as it continues to unfold, is also the product of individuals, who made it into the global phenomenon that it is. As we study the biographies of jihadis, we are faced with a world crowded with different and differing worldviews. Beneath the banner of jihad that seemingly unites jihadis worldwide is a world marked not just by cooperation between groups and individuals, but also by competition and divisions. Some of the jihadis who occupy that world are characterized by a commitment to idealistic goals, by acumen, skills, and agility; others are driven by sectarianism, criminal disposition, and opportunism; while others manifest an odd combination of all. That is why the actions emanating from the jihadist landscape are the results of an amalgam of strategy, sophisticated planning and targeting, randomness, and juvenile enthusiasm. It is for these reasons and more that the complexity of the jihadist landscape requires different layers of analyses and a rigorous and patient approach to the subject. In short, the study of jihadism is about both the “forest” and the “trees;” and this series of biographies is a study of the “trees” as they are situated in the broader “forest.”

45. Purveyors of Terror: Counterterrorism in Africa's Failing States

Abstract:
Weak and failing states in Africa continue to offer challenging environments for counterterrorism campaigns in both a military and a civil law enforcement context. Weakly governed and ungoverned spaces in these states offer venues that violent extremist groups continue to exploit as platforms for terrorism. These groups – Al-Qaeda in the Islamic Maghreb (AQIM) and Al-Shabaab in Somalia are simply two of the more prominent examples – use these weakly governed and ungoverned spaces to recruit new followers, build capability and capacity, and launch new terrorist attacks while avoiding the scrutiny and attention of African security sectors and their international partners. A defining feature of these weakly governed and ungoverned spaces in Africa is the predominance of non-state security actors, including local militias, neighborhood watch organizations, traditional hunting societies, and traditional, customary, or religious justice processes that operate outside of the formal court system. Some of these non-state actors themselves represent violent extremist groups involved in acts of terror. Others play central roles in the mediation of disputes (administration of justice), delivery of police services, or as military surrogates in providing for local defense. I argued in Counterterrorism in African Failed States that collaboration between U.S. military forces and law enforcement agencies is essential to effective counterterrorism interventions in African failed states.[i] Subsequent counterterrorism operations in the region have confirmed that argument, and African senior police and militaryleaders increasingly emphasize the importance of collaboration between military and police forces.[ii] In addition to military forces and law enforcement services, counterterrorism in Africa must effectively address the need for effective partners in the justice sector – prosecutors (and defense counsels), courts, prisons and corrections – in implementing counterterrorism strategies. All three components of counterterrorism strategies must confront the reality that weakly governed and ungoverned spaces are ground zero for counterterrorism on the continent, and that non-state security actors are a defining feature of those spaces. To address the purveyors of terror – in most cases, non-state security actors like Al-Shabaab in Somalia or AQIM in the Sahel – counterterrorism strategies in ungoverned and weakly governed spaces in Africa must address all of the non-state security actors that proliferate in those areas.

46. To pay or Not to Pay? Citizens’ Attitudes towards Taxation in Kenya, Tanzania, Uganda and South Africa

Abstract:
This paper examines factors that determine citizens’ tax-compliance attitude in Kenya, Tanzania, Uganda and South Africa. Using the 2011/12 Afrobarometer survey data, we find that tax-compliance attitude is positively correlated with the provision of public services in the four countries. However, the correlation depends on the specific service in question and differs between countries. Tax knowledge and awareness are found to be positively correlated with tax-compliance attitude. On the other hand, frequent payment to non-state actors in exchange for security and individual’s perception that their own ethnic group is treated unfairly by the government are negatively correlated with tax-compliance attitude.

47. A Turn to Non-State Actors: Inducing Compliance with International Humanitarian Law in War-Torn Areas of Limited Statehood

Abstract:
Many of the perpetuated armed conflicts in the Great Lakes Region in Africa take place in war- torn areas of limited statehood. These conflicts are characterized by a high number of civilian victims, often resulting from utter disregard for international humanitarian law. Here, the rise of armed, violent non-state actors collides with the State-centric traditional nature of public international law. Thus, (classical) compliance structures seem to lose their significance, as they predominantly rely on the State for law enforcement and therefore mainly accommodate States’ interests when inducing compliance. The working paper suggests that the international com- munity responds to these challenges by allocating competences to other actors than the State. Particularly, international organizations increasingly contribute to enforcing international hu- manitarian law. However, since these organizations are dependent on their member States’ political willingness to support measures for inducing compliance effectively, a proliferation of humanitarian non-state actors can be observed that step in where third States and international organizations are reluctant to act. The paper investigates reasons for compliance and arrives at the conclusion that traditional motives rooted in a logic of consequences, as well as appropriate- ness are still valid and must therefore be addressed by the corresponding compliance mecha- nisms. These compliance mechanisms are interdependent and mutually reinforcing. Persuasion and incentives work more effectively if they are used under a shadow of hierarchy thrown by coercive legal enforcement instruments, such as international criminal justice and UN targeted sanctions. These instruments are in turn more effective if they are part of a concerted effort.

Cultural diplomacy is usually limited spatially to the European and American areas and most is mostly investigated for the period of the Cold Wr. What the two intend to do is extend both the geographical and temporal limits to African and Asian continents as well as back to the middle of the 19th century, as is the Japanese case. What Jessica C.E. Gienow-Hect and mark C. Donfried attempt in this work is to offer a comprehensive view of the term "cultural diplomacy" not only by looking as its multiple aspects, but also offering throughout time and space various examples of such a practice. As "cultural diplomacy" is not only a term, but also a valuable practice employed by both state and non-state actors.

49. Justice through Armed Groups' Governance - An Oxymoron?

In this paper, the author addresses the question of whether armed groups’ courts are suitable to enforce international humanitarian law. The ensuing question of whether the existence of these courts conforms to international law is answered in the affirmative: international humanitarian law and human rights law do not in principle prohibit the operation of such courts. Adjudication by armed groups has a relatively high potential to deter the groups’ fighters from committing violations of international humanitarian law. This is to a large extent because convictions by armed groups’ courts gain more attention among fighters than convictions by national or international criminal courts. However, the empirical record of armed groups’ courts is mixed. The African armed groups examined in this paper violated international humanitarian law, including due process guarantees. Yet, they showed more respect for civilians than many armed groups without their own jurisdiction.

50. The Central Margins: Congo’s Transborder Economy and State-Making in the Borderlands

Abstract:
Timothy Raeymaekers has spent eight years doing fieldwork in the Congolese-Ugandan borderlands, a region that often calls up images of isolation and remoteness, where predatory and armed men ravage, and where death arrives suddenly and unexpectedly. To most people, the eastern Congolese borderlands represent a perversion of economic development, where criminal gangs and looting militias rule on the ruins of state collapse. But rather than collapsed statehood and economic development-in-reverse, Raeymaekers in this DIIS Working Paper argues that the interdependencies and accumulation strategies developed during Congo's protracted crisis have gradually made this borderland a crucial pillar in the equilibrium forces between formal and informal, state and non state actors and regulations in this territorial periphery - which has subsequently become a central margin in today's regional processes of state formation.
