51. Whistleblowing: an effective tool in the fight against corruption

Abstract:
Whistleblowing is increasingly recognised as an important tool in the prevention and detection of corruption and other malpractice. By disclosing wrongdoing in an organisation, whistleblowers can avert harm, protect human rights, help to save lives and safeguard the rule of law. The clandestine nature of corrupt behaviour means that it may never come to light unless cases are reported by people who discover them in the course of their work. But reporting can come at a high price: whistleblowers often expose themselves to great personal risks in order to protect the public interest. As a result of speaking out, they may lose their jobs, dampen their career prospects, and even put their own lives at risk. To provide a safe alternative to silence, TI recommends policy and legal measures to provide: Effective legal protection of whistleblowers against retaliation with full compensation in case of reprisals; Adequate mechanisms in public, private and not-for-profit organisations to ensure that disclosures are properly handled and thoroughly investigated; Public research, data collection, information and training to inform about the public benefit of whistleblowing.

The idea for this handbook came from the massive humanitarian response to the Asian tsunami, when the huge levels of resources committed by the international community created concern about new opportunities for corruption. Many international development agencies have put in place corruption prevention polices tailored to development programmes, but there was a noticeable gap in policies for preventing corruption in emergencies. Based on extensive research within and beyond the humanitarian sector, as well as detailed input from the humanitarian community itself, this handbook aims to fill that gap. It offers a menu of good practice tools for preventing and detecting corruption in humanitarian operations.

Public procurement affects all aspects of people's lives and assumes a large share of government budgets. The acquisition of buildings and land by municipal and national governments, the construction of roads, the provision of health and education services, and the construction and operation of drinking water and sanitation systems are just a few examples of public investments that involve procurement. The Organisation for Economic Co-operation and Development (OECD) has estimated the value of government procurement markets worldwide to be US$ 2 trillion annually. Wherever such large quantities of money change hands, the risk of corruption is high.

Political corruption doesn't just mean electoral fraud; it includes the growing role of private rather than public interests in elections and public policy making. Along with the increasing influence of money in politics, this undermines public trust in democracy and its institutions. Transparency International's 2009 Global Corruption Barometer found that the general public see political parties as the most corrupt domestic institution, followed by civil servants and parliaments. In developing and transition countries, where democratic institutions remain fragile, political corruption diverts resources from providing basic social services for millions of poor and disadvantaged people.
