Abstract:
The human rights crisis in Mexico and particularly the one with migrants in transit through Mexico is not coincidental. The increased securitization of migration has transformed it into a security issue, causing it to be a threat to the national security. The mechanisms and strategies to fight against this crisis has led to terrible consequences to the thousand of migrants that pass through Mexico every year. As stated by David Harvey, the conceptualization of the irregular migration as a threat to the Nation-States has occurred as a consequence of the “global unequal capitalist integration”. This is a structural process that promotes global inequality in a parallel way, creating the undocumented as the others unwanted (Álvarez and Guillot, 2012:24). We then have migration as a phenomenon characterized by the economic globalization and the predominance of the logic of social exclusion, that it reveals itself as a feature for nations and families in their need to seek, among other things, improved living conditions in places that are different from their place of origin

Abstract:
In the academic world, scientific literature comes mainly from the western part of the globe. Ramón Grossfoguel believes that knowledge is determined by power relations in the "post-colonial" era (Grossfoguel, 2002: 16). This means that Western powers dominate the academic world. In constitutional law, this is not the exception. However, while we can accept that it is true that many constitutional provisions, doctrine, jurisprudence and theories of Western constitutional law have influenced Latin American countries, most of these countries have also developed their own constitutional systems that have specific and new features, whose unique identity differentiates them from other systems in the world. In this paper, I will try to study the special features that Bolivia, Ecuador, and Colombia have in the recognition of indigenous rights and legal pluralism, whose discursive axis entails a “decolonizing” spirit which is the retrieval of their own institutions against the trends of hegemonic governance of the western culture as I will explain later. Latin America has faced numerous problems concerning social differentiation. In the opinion of one of the most cited authors in Latin American constitutional law, Raquel Yrigoyen, the disadvantaged were left behind from the social, economic and political issues through legal measures created by people of a favored minority, in order to maintain privileges (Yrigoyen, 2011: 139). In the case of Latin America, many of the disadvantaged match to be those survivors of the brutal Spanish conquest; the native Indians. I have chosen these three countries since they have a significant indigenous population; more than 36.6 million indigenous people in the region. In Bolivia, the number rises to 4,115,222 natives, in Ecuador 1018176,and in Colombia 1392623. (World Bank, 2014: 24-25) The Constitutions of Colombia (1991), Ecuador (2008) and Bolivia (2009) reflect the new “decolonizing” ideology; Colombia through its jurisprudence, on the one hand, and Bolivia and Ecuador, proclaiming themselves "Plurinational”countries on the other. All made great strides in recognizing indigenous rights and, consequently, in gaining their social inclusion. (Gargarella, 2014: 175) Constitutional systems are a product of history and the struggle of peoples. In these cases, the effort to include indigenous peoples in the economic, political and social spheres resulted in these new constitutional models which can be understood through a comparative study.By understanding this, advantages and disadvantages of each country to improve social inclusion of indigenous peoples in all the mentioned spheres can be found. In the first title, I will talk about the meaning of legal pluralism. In the second, I will discussthe new models of statewhich are conditioned by legal pluralism and indigenous rights. In the third, I will address indigenous autonomies and jurisdictions that are the subject of our study. And in the remaining two titles, I will discuss the most distinctive features, and rights arising from the recognition of this unique legal pluralism. All this with the purpose of exposing the new constitutional spirit of "decolonization" of these countries.

Abstract:
This paper provides a general overview of U.S. housing policy, with emphasis on state and local programs. Despite the focus on local programs we also discuss the broader national policy environment. This broader context is necessary because national policies play a crucial role in shaping the country's housing markets. We briefly trace out some of the key features of the housing market, highlighting tenure distributions, housing conditions and costs. Particular emphasis is given to the role of increasing housing costs and the housing opportunities of the poor. The paper also describes: (1) the nation's housing finance and tax systems, focusing on the different ways the government uses the tax code to subsidize homeowners and renters; and (2) state and local government programs, often implemented in the close collaboration of nonprofit organizations. A final section provides a brief overview of the strengths and weaknesses of U.S. housing policy and the evolving role of sub-national governments.

Abstract:
This paper explores “system vulnerability thinking” as a specific response to the exigencies of thermonuclear war in the 1950s. It is one part of a collaborative project with Andrew Lakoff on the government of catastrophe in the post - World War II United States. The project focuses on the forms of expertise, the knowledge practices, and the governmental institutions that have been invented to anticipate and manage potential catastrophes, from natural disasters, to pandemic disease, to terrorism, to energy crises. In this project we have identified the reconfiguration of US government in the early years of the Cold War as a crucial moment in which the government of catastrophe in the post - World War II US took shape.

Abstract:
This paper asks how the world of sovereign countries should arrange itself to address global and international economic, financial, social or environmental problems. The current system of institutions and arrangements, informally led by the Group of 20, as convoked by the United States, is hardly ideal. The paper proposes a “pragmatic” alternative with multiple checks and balances, but able to reach timely and effective decisions on the full range of international policy issues. The paper concludes noting that dissatisfaction with current arrangements has reopened intergovernmental debate; it is not the same as undertaking reform, but it is a start.

Abstract:
The United States' national security objectives emphasize preventing terrorism through economic and social development in fragile states. Helping to create economic prosperity and legitimate and politically accountable institutions of governance in weak states poses many complex challenges that the international development community and US civilian aid agencies have struggled to address. New US military counterinsurgency doctrine defines “Phase Zero” non - combat development activities as a core military mission equal in importance to that of its combat missions. The US military lacks the development expertise to effectively engage fragile states, as demonstrated by its record in Iraq. The result is a narrow, instrumental understanding of the relationship between security and development that ironically undermines, rather than strengthens, a coherent and effective strategy for dealing with failed states.

Abstract:
This paper outlines some elements of the genealogy of vital systems security. Vital systems security is a way of “problematizing” threats to security that can be contrasted to the forms of sovereign state security and population security that Michel Foucault famously analyzed in his lectures on governmentality. Vital systems security takes up events that are uncertain and unpreventable but potentially catastrophic. Its object of protection is the complex of critical systems or networks on which modern economies and polities depend. Vital systems security is, thus, linked to the idea that the very success of industrial and social modernity in managing risks has in fact generated new risks.

Abstract:
In the U.S.-Iran nuclear crisis, U.S. motivations stem from its role as protector of today's market-centered, global oil system, herein "The One Global Barrel." This market itself is the principal basis of global energy security today, unlike the political-economics of the old neo-colonial system. But, most light-oil reserves are in P ersian Gulf states— Saudi Arabia, Kuwait, the UAE, Iran and Iraq. U.S. Grand Strategy prevents any from projecting power affecting another's production and undermining the open market. Hence, Iraq was driven from Kuwait, placed under sanctions and the Ba'athists overthrown. Iran alone now projects power independently. Its nuclear program is a gambit for a Grand Bargain to lift oil sanctions without surrendering Regional power status, or to accomplish this asfait accompli. A future national-democratic Iran could find U.S. limits on sovereign power equally obnoxious. These underlying oil-market interests must be publically recognized to advance negotiation of the present crisis.

9. A Postcolonial-Feminist Alternative to Neoliberal Self/Other Relations

Abstract:
The neoliberal 'good life' demands one, unequivocal condition: convert or be disciplined. Conversion requires wholesale integration of the neoliberal Self's policies, practices, and institutions at all sites of public policy-making for the Other, regardless of local histories, cultures, or desires. Discipline comes through economic, political, and sometimes military 'conditionalities' from the Self to the 'non-compliant' Other. That both conversion and discipline mean a kind of annihilation for the Other is, for the neoliberal Self, a necessary risk. This includes the rise of rival camps of hypermasculinity that lead, invariably, to perpetual cycles of competition and conflict. A 'borderlands' approach offers an alternative. Similar to 'traveling' theory from feminists of color, this notion of 'borderlands' also draws from pre-colonial experiences such as the ancient Silk Roads where peoples, societies, languages, religions, and ways of life mixed, merged, and moved. 'Borderlands', in short, exemplifies a multiple worlds ontology to world politics. Three cases illustrate the pitfalls of neoliberal Self/Other relations and why we need to move to the 'borderlands': (1) the Asian financial crisis (1997-1998), (2) US corporate corruption (2001-2002), and (3) the 9/11 Commission Report (2004).

10. "The Kitsch of War: Misappropriating Sun Tzu for an American Imperial Hypermasculinity

Abstract:
Sun Tzu seems more popular than ever. The Bush Administration attributes its successful invasions of Afghanistan and Iraq to tactics in The Art of War such as “shock and awe” and “decapitation.” However, neither exists in Sun Tzu's manual. More seriously, this misappropriation reinforces an imperial hypermasculinity in US foreign policy given its neoliberal logic of “conversion or discipline” for Self/Other relations. Rival camps of imperial hypermasculinity arise in reaction, thereby rationalizing the US Self's resort to such in the first place. Locking the world into ceaseless rounds of hostility between opposed enemies, we argue, contradicts Sun Tzu's purpose. The Art of War sought to transform, not annihilate, the enemy as mandated by the cosmo-moral, dialectical world order that governed Sun Tzu's time. In misappropriating Sun Tzu, then, the Bush Administration turns The Art of War into mere kitsch.
