Abstract:
This paper provides an analysis of the ongoing stabilization and state-building process in Afghanistan with a focus on rule of law. It has two aims: first, to situate rule of law reform within the framework of the broader stabilization and state-building effort in Afghanistan. Second, to analyze if and how the internationally-supported and implemented strategies for rule of law reform are contributing to the promotion of rule of law in Afghanistan.

Abstract:
There is an expectation that the West, and the United States in particular, faces catastrophe in Iraq and Afghanistan. Confronted with significant casualties arising from the employment of asymmetric warfare by determined adversaries, the United States and its NATO and Coalition partners have found decisive solutions to both conflicts elusive. Similarly, the challenges confronting Iraqis are daunting, and according to the recently released declassified Key Findings of the U.S. National Intelligence Estimate, dependence on Coalition forces as an essential stabilizing element in Iraq will continue.

Les attentats du 11 septembre 2001 ont profondément transformé la perception de la menace terroriste dans le monde et le rôle des Etats et des organisations internationales dans la lutte contre celle-ci. La réponse de l'Organisation du Traité de Atlantique Nord (OTAN) a été immédiate et ferme. Le 12 septembre, elle a invoqué, pour la première fois dans son histoire, la clause de défense collective relevant de l'article 5 du Traité de Washington, qui se traduira en pratique, quelques jours plus tard, par le lancement de huit mesures visant à soutenir les Etats-Unis. L'une de ces mesures consiste à déployer des unités des forces navales permanentes en Méditerranée orientale. Le 26 octobre 2001, est lancée l'Opération Active Endeavour (OAE), première et unique opération maritime de lutte contre le terrorisme menée sous l'égide de l'OTAN. Entre 2001 et 2006, l'OAE a vu son champ d'action s'élargir de la sous-région orientale à l'ensemble de la Méditerranée. Le Sommet de l'OTAN à Istanbul en juin 2004, a redimensionné l'OAE en invitant les partenaires1 de l'Alliance à y contribuer. Depuis lors, une dizaine d'Etats du Partenariat pour la paix (PPP) et du Dialogue méditerranéen (DM) ont répondu favorablement à cette invitation: la Russie, l'Ukraine et Israël sont dans une phase d'intégration très avancée; le Maroc, l'Algérie, la Croatie, la Géorgie et la Suède en sont à la phase de négociation intermédiaire.

The participants agreed that the NPT is under challenge. Since the late 1990s, there has been growing concern about increasing proliferation dangers, including rogue states and terrorists; cooperation on weapons of mass destruction (WMD) among rogue states; technology diffusion via the Internet as well as through “loose nukes,” materials leakage and brain drain from former Soviet republics, Pakistan and other states and through non-state actors like the A. Q. Khan network; and problems with export controls. The prospects of radiological or nuclear terrorism are seen to be rising; and concern over a proliferation/terrorism nexus after 9/11 has never been higher.

Ukraine's return to Europe, or in other words the process of its becoming a member of key international organizations – namely the EU and NATO – appeared to be complicated, lasting and far from any romantic notions. Besides the need for consensus from society as a whole and from the Ukrainian leadership, appropriate governmental and parliamentary decisions were also required; these factors demonstrating the necessity of serious, internal changes in all spheres of state activity. In practical terms, the basis for these requirements remains to be established: a mutual understanding of key questions of state life, national and international security, internal and foreign policy priorities.

On 3-4 November 2005 the NATO Defense College hosted a seminar, co-sponsored by the Ministry of Defense of Finland, regarding NATO and European Union post-conflict reconstruction operations. The participants included officials from NATO and the EU, as well as experts and officials from NATO, EU, and Partnership for Peace nations. The seminar objectives included:-promoting more effective EU-NATO teamwork in such operations,-evaluating the main problems and achievements to date, and-assessing lessons from operations in Afghanistan in particular.
