1. Taiwan’s Export Control System: Overview and Recommendations

Abstract:
This report provides an overview and assessment of Taiwan’s export control program, with a focus on strategic high-tech commodities (SHTC). It highlights Taiwan’s global position as a major port for both shipping and dual-use exports, identifying the key legislation and organizations that address SHTC exports. It thoroughly examines the key organizations, legislation, licensing procedures, and challenges within Taiwan’s export control system. Overall, Taiwan has a strong, modern export control system, and any deficiencies are similar to other jurisdictions of the same size in terms of trade and shipping. Nonetheless, Taiwan’s isolation in the international community continues to make it a target for illicit trade, including financing of items related to weapons of mass destruction (WMD). Using open-source data, this report identifies twenty-five export-control cases involving Taiwanese persons and/or entities. All of these cases were prosecuted in Taiwan or abroad. In an attempt to identify unprosecuted cases, researchers incorporated publicly available data, including the Panama Papers. The report finds no evidence of unprosecuted illicit WMD-related trade. Despite its international isolation, Taiwan has an opportunity to become a leader in safe international trade. By fully embracing export control and proliferation finance laws and enforcement, Taiwan could become a natural hub for export controls

This report summarizes the analysis and findings of our research project entitled “Evaluating WMD Proliferation Risks at the Nexus of 3D Printing and Do-It-Yourself (DIY) Communities.” Conducted by a team with the Middlebury Institute of International Studies at Monterey’s (MIIS) James Martin Center for Nonproliferation Studies (CNS), this project builds upon emerging literature in the weapons of mass destruction (WMD) nonproliferation field highlighting additive manufacturing (AM) — which includes 3D printing — as a potential proliferation risk. This project analyzes a set of export-controlled items to understand the degree to which 3D printing might be used to produce — and thus represent a new pathway for proliferators to acquire — dual-use goods useful for the development of WMDs. Additionally the study considers the degree to which communities using and promoting 3D printing may impact the risk of WMD proliferation.

3. Planning Ahead: A Blueprint to a Middle East WMD Free Zone

Abstract:
Freeing the Middle East from all weapons of mass destruction (WMD) and establishing a weapon-of-mass-destruction-free zone (WMDFZ) is a concept that originated many decades ago. Although this idea has existed for more than forty years, surprisingly little thought has been given to how it can be realistically implemented. Currently, there remain significant gaps regarding core concepts of the WMDFZ (the “Zone”) negotiations and implementation within the Middle East and internationally. The James Martin Center for Nonproliferation Studies offers a new report in an effort to address these gaps with regard to the planned WMDFZ Middle East Conference, negotiation process, and the subsequent establishment of such a Zone by identifying the legal, technical, and organizational elements required to support the Zone negotiations and implementation. Creating a WMDFZ is a very tall order; not only has one never been created before, but also all existing nuclear-weapon-free zones (NWFZs) formalized an already existing situation—the absence of nuclear weapons in their region. The WMDFZ, by contrast, is aimed at reversing the status quo by dismantling existing WMD capabilities and programs in a region that is suspected of hosting all three categories of WMD. Moreover, the region suffers from deep-rooted conflicts and mistrust, and many areas are undergoing considerable social and political change. The increasing influence of non-state actors on states’ affairs in the region is another complicating factor. Additionally, while there are regional and international regimes and organizations charged with verifying the peaceful nature of nuclear energy programs and chemical industries (all of which could inform the WMDFZ negotiators), there are no comparable mechanisms to cover nuclear and biological weapons dismantlement, verify sensitive activities for biological programs, nor sufficiently regulate WMD delivery systems—all of which are mandated under the Middle East WMDFZ.

4. Ugly Truths: Saddam Hussein and Other Insiders on Iraq’s Covert Bioweapons

Abstract:
Although the inspections of the United Nations Special Commission (UNSCOM), which operated from April 1991 to October 1998, unmasked Iraq’s biological weapons program and revealed a considerable amount of detail about its planning, organization, and execution, various factors about the program remain unclear. These gaps in information persisted through the activities and reporting of both the United Nations Monitoring, Verification, and Inspections Commission, which existed from December 1999 until the outbreak of the second Gulf War in March 2003, and the Iraq Survey Group, which reported on the remnants of Iraq’s weapons of mass destruction capabilities after the 2003 Gulf War.1 To deepen understanding about Iraq’s biological weapons program, a team of analysts from the James Martin Center for Nonproliferation Studies (CNS) identified a number of research questions that, if answered, would provide a more comprehensive account of Iraq’s biological and chemical weapons programs. The twenty research questions ran the gamut of relevant topics. Specifically with regard to the bioweapons program, the research questions sought to clarify the reasons behind Iraq’s choice of biowarfare agents and delivery systems, the timeline and technical specifics for certain activities, possible interaction with governments and biowarfare experts outside of Iraq, the management of the program, and the details of how Iraq disposed of its biological munitions and bulk biowarfare agent. In an effort to answer some or all of these questions, CNS’s staff turned to the records of the Conflict Records Research Center (CRRC) database. In mid-July 2011, the time in which CNS’s staff reviewed the CRRC records for information pertinent to Iraq’s biological weapons program, it should be noted that a relatively small fraction of the documents in the possession of the CRRC had been translated into English and made available in the CRRC database. Accordingly, the review of the database did not turn up a tremendous number of documents providing insights about Iraq’s biological weapons program. Nonetheless, the review uncovered several documents that shed light largely on the political management of Iraq’s bioweapons program and how Iraq’s leaders tried to cope with UNSCOM’s inspections. This report, which begins with a brief review of the search methodology, otherwise presents the research findings in rough but not exact chronological order. To help the reader quickly grasp the relevance of the research findings in a history that is complicated and sometimes full of technical detail, the research findings are interlaced with background derived largely from Germ Gambits: The Bioweapons Dilemma, Iraq and Beyond (Stanford University Press, 2011). Germ Gambits, which tells the tale of UNSCOM’s bioweapons inspections in Iraq, is based primarily on interviews with UNSCOM inspectors, buttressed by UNSCOM documents and secondary materials. Therefore, any citation to Germ Gambits is based on numerous authoritative sources. Because this report provides the unadulterated Iraqi view on certain topics, in a certain sense it is like seeing the other side of the coin that Germ Gambits presents. CNS Senior fellow Amy E. Smithson, PhD, wrote Germ Gambits and was the principal researcher reviewing the biological weapons-related documents in the CRRC database.

Abstract:
The Eighth Review Conference (RevCon) of the Treaty on the Non-Proliferation of Nuclear Weapons (NPT) concluded on May 28, 2010 with the adoption by consensus of Conclusions and Recommendations for Follow-on Actions, which contain 64 action items across the three pillars of the NPT: nuclear disarmament, nonproliferation, and peaceful uses of nuclear energy. An additional set of recommendations contained in the final document pertains to the implementation of the 1995 Resolution on the establishment of a zone free of weapons of mass destruction (WMD) in the Middle East. While the adoption of the “action plan” was widely and deservedly regarded as a success, its long-term impact will depend on the implementation by the NPT member states.

Abstract:
Control of tractical nuclear weapons (TNW) has remained an elusive goal since the early 1990s when the United States and the Soviet Union/Russia adopted a set of unilateral parallel political obligations to reduce and store at central locations the larger part of their TNW forces. Efforts by the international community to nudge the two countries to give these unilateral statements a legally binding, verifiable character did not succeed, and one can point to little headway with respect TNW arms control in the intervening 18years.

In late April 2009, the Policy Planning Staff of the Foreign Ministry of the Federal Republic of Germany requested that the James Martin Center for Nonproliferation Studies (CNS) undertake studies on four emerging issues in the fields of arms control, disarmament, and nonproliferation, to be completed by June 15, 2009. The four issues were: The need to address the interrelationship between nuclear and conventional arms reduction, if the United States wants to entice others to go along the path to Global Zero. The world after drastic nuclear arms reductions, including the fear of U.S. conventional superiority/global strike capabilities;  The need (and promising areas) to make (nuclear) arms control and disarmament a strong component of NATO's new strategic concept;  Missile Defense, also covering a possible threat from others than Iran and the need to bring missile defense into the NATO-Russia Council; and Substrategic nuclear weapons, with a description of a way to achieve mutual transparency, reduction, and elimination in Europe.

Abstract:
Today two key nuclear powers, China and Russia, stand at the crossroads of nuclear policy: both Beijing and Moscow are reassessing their nuclear policies and postures. The decisions they make will affect their negotiating positions for years to come; therefore, now is the time to engage both countries in discussions about deep nuclear reductions that could ultimately lead to the elimination of their arsenals. Such actions will contribute to reaching “nuclear zero”—the complete elimination of all nuclear weapons—an idea that was the focus of two recent opinion articles coauthored by George Shultz, William Perry, Henry Kissinger, and Sam Nunn, who stressed the necessity of “turning the goal of a world without nuclear weapons into a practical enterprise among nations.”

10. Trafficking Networks for Chemical Weapons Precursors: Lessons from the Iran-Iraq War of the 1980s

Abstract:
States seeking to produce chemical weapons (CW) typically rely on the importation of intermediate chemicals called “precursors,” which have legitimate industrial applications but can also be converted into military-grade CW agents, such as mustard gas or sarin. The dual-use nature of precursor chemicals poses challenges for policy makers seeking to prevent CW proliferation. Under U.S. Department of Commerce regulations, manufacturers planning to export CW precursors to certain countries must obtain prior government authorization in the form of an export license. Yet despite significant improvements over the past decade in the export-control systems of the United States and other industrialized countries, trafficking in precursors and other dual-use items relevant to CW production has continued.
