1. Nepal's Fitful Peace Process

Abstract:
Nepal is entering a new phase in its fitful peace process, in which its so-called "logical conclusion" is in sight: the integration and rehabilitation of Maoist combatants and the introduction of a new constitution. The Maoists, the largest party, are back in government in a coalition led by the Communist Party of Nepal (United Marxist-Leninist), UML party. Negotiations, although fraught, are on with the second-largest party, the Nepali Congress (NC), to join. Agreement is being reached on constitutional issues and discussions continue on integration. None of the actors are ramping up for serious confrontation and few want to be seen as responsible for the collapse of the constitution-writing process underway in the Constituent Assembly (CA). But success depends on parties in opposition keeping tactical threats to dissolve the CA to a minimum, the government keeping them engaged, and the parties in government stabilising their own precariously divided houses. It will also require the Maoists to take major steps to dismantle their army.

Abstract:
Nepal's peace process has moved into a phase of definitive progress. More than five years after the ceasefire, the parties have reached a deal on the Maoist fighters, who will leave the cantonments and enter the army or civilian life. An unofficial deal sets out power-sharing arrangements until the next election. The parties are focusing on the critical task of writing a new constitution, which promises a deep restructuring of the state to become more representative and decentralised. Challenges remain, including from continuously evolving coalition dynamics and divisions within parties. There will also have to be further discussions on the combatants. As the parties discuss federalism, which of all peace process issues goes most to the heart of ordinary Nepalis' expectations and anxieties, groups within and outside the Constituent Assembly will see their options narrow, which could strain the process. Yet, this is still the best chance the parties have had to reach formal closure on the war and to institute some of the fundamental changes they promised, provided they have the courage to make far-sighted compromises.

Failure to address the systematic crimes committed during Nepal's ten-year civil war is threatening the peace process. There has been not a single prosecution in civilian courts for any abuses. The cultures of impunity that enabled the crimes in the first place have remained intact, further increasing public distrust and incentives to resort to violence. The immediate priorities should be prosecutions of the most serious crimes, investigation of disappearances and action to vet state and Maoist security force members.

Nepal's transition from war to peace appears chaotic. Many commentators warn of coming anarchy; the establishment fears a collapse of the social order and the fragmentation of the nation. But such fears are misguided. Nepal is not in chaos; its transitions may be messy and confusing but they are not anarchic. There is an order within the political change, albeit one that can be mysterious and unappealing to outsiders; the resilience of Nepal's political processes acts against fundamental transformations.

Nepal's peace process is in danger of collapse. The fall of the Maoist-led government, a mess largely of the Maoists' own making, was a symptom of the deeper malaise underlying the political settlement. Consensus has steadily given way to a polarisation which has fed the more militaristic elements on both sides. While all moderate politicians still publicly insist that there is no alternative to pursuing the process, private talk of a return to war – led by generals of the Nepalese Army who have never reconciled themselves to peace – has grown louder. Outright resumption of hostilities remains unlikely in the short term but only concerted efforts to re-establish a minimal working consensus and a national unity government including the Maoists can avert the likelihood of a more dangerous erosion of trust. Strong international backing, with India eschewing short-term interference in favour of longer-term guardianship of the process it itself initiated, will be essential.

Despite successful elections and a lasting military ceasefire, Nepal's peace process is facing its most severe tests yet. Major issues remain unresolved: there is no agreement on the future of the two armies, very little of the land seized during the conflict has been returned, and little progress has been made writing a new constitution. Challenges to the basic architecture of the 2006 peace deal are growing from all sides. Key political players, particularly the governing Maoists and the opposition Nepali Congress (NC), need to rebuild consensus on the way forward or face a public backlash. International supporters of Nepal must target assistance and political pressure to encourage the parties to face the threats to peace.

Abstract:
Nepal's peace process faces a crucial test this month. Elections for a Constituent Assembly (CA) are likely to go ahead on 10 April 2008 as scheduled but political unrest and violence could mar – or even derail – preparations, and the aftermath could bring turbulence. Elections in a delicate post-conflict situation are never straightforward and Nepal has many possible flashpoints, not least that the two armies that fought the war remain intact, politically uncompromising and combat-ready. Once results are in, all political players must be prepared for a difficult period in which they will need to compromise to make the CA an effective body, extend the number of parties with a role in government and urgently tackle crucial issues left aside during the campaign, including security sector reform. The international community has an important election observation function and should listen to Nepal's political and civil society groups in assessing the credibility of the process.

Nepal's constituent assembly (CA) elections marked a major step forward in the peace process, paving the way for the declaration of a federal democratic republic and the start of the constitution-writing process. Although falling short of an outright majority, the Maoists won a decisive victory at the 10 April 2008 polls, securing a mandate for peace and change. However, the largely peaceful and well-managed vote opened a messy new round of political haggling and obstruction. The Maoists have been unable to secure agreement on a new coalition government. Other parties, still struggling to accept their defeat, have set new conditions for supporting a Maoist-led administration.

Abstract:
Nepal's Maoists crowned their transition from under- ground insurgency to open politics with a convincing victory in 10 April 2008 constituent assembly (CA) elections. Their surprise win has thrown other parties into confusion, with the major mainstream ones unwilling to recognise their defeat and participate in a Maoist-led government, despite clear pre-election and constitutional commitments to maintaining cross-party unity. The CA nearly unanimously ended the monarchy at its first sitting and gave birth to the Federal Democratic Republic of Nepal. However, extended, unedifying haggling over government-formation suggests the consensus-based approach to the constitutional process will be hard to implement. Building a lasting peace and delivering the change voters called for requires all parties to accept the new situation and cooperate under a Maoist-led government, in particular to deal with issues scarcely yet addressed including the security sector, reestablishment of law and order in some districts, land and local government.

Abstract:
Nepal's progress toward lasting peace is seriously but not yet irreparably faltering. A further postponement of constituent assembly (CA) elections reflected the weak implementation of the November 2006 Comprehensive Peace Agreement (CPA) and lack of will to follow the agreed process. Leaders have now vowed to forge a new consensus and agreed to hold the elections by mid-April 2008 but have yet to address the problems that led to past postponements. Suspicions among the parties – especially between Nepali Congress (NC), which dominates the government, and the Maoists, who remain outside – are echoed in ebbing public confidence: whatever promises they hear, most voters believe the politicians prefer to stay in power rather than face the electorate. All parties urgently need to inject new momentum into the peace process and take steps to win back trust and earn legitimacy.
