1. Strangers as Enemies: Further Reflections on the Aporias of Transnational Citizenship

Abstract:
These new reflections on the issue of "transnational citizenship" and its aporias, which I have the possibility to submit for discussion owing to the generous invitation of the Institute on Globalization and the Human Condition at McMaster University, will be presented from a European point of view, as I have done in previous essays on the same subject. But I will try to do so also in the perspective of a comparison, or better said, a confrontation, with North America, of which you are part, and where I have been working now regularly for years, albeit across the border. I do not believe in the possibility of speaking about "the global" from a point of view itself "global" -- that is, from nowhere or everywhere. But I believe in the (relative) possibility of dis-locating one's point of view, one's place of enunciation, and above all of exposing oneself to the dis-location that comes from others.

Abstract:
The Elusive Basis of Legitimacy in Global Governance: Three Conceptions How to create and maintain legitimacy is arguably the greatest contemporary challenge to global governance and international order. To address this challenge, International Relations scholars, accustomed to a clear distinction between international and domestic legitimacy, have had to borrow extensively from the fields of political philosophy, comparative politics, law, and sociology, which have long investigated the legitimate basis of political authority. These traditions inform three distinct conceptions of legitimacy in this new wave of scholarship: 1) principled legitimacy rooted in democratic politics; 2) legitimacy as law or legalization; and 3) a sociological conception of legitimacy rooted in intersubjective beliefs about appropriateness. Each conception provides only partial insight into the core puzzle animating this literature: what does political authority beyond the state require? The answer can only be found through an examination of the relationship of power, legitimacy, and community, which together constitute political authority.

3. Democratizing Globalization? Impacts and Limitations of Transnational Social Movements

Abstract:
This paper examines the organizational foundations for global democracy that have been developed through the efforts of generations of activists who have conceptualized their struggles in transnational or global terms. A broad look at the history of transnational activism shows that the “battle of Seattle” against the World Trade Organization had its origins well before the fall of 1999. It also shows that activists from poor countries have played strong roles in shaping the course of past global activism, and they are likely to play central roles in defining the future course of global struggles for democracy and social justice. Finally, we see that transnational activism has helped cultivate skills, collective identities, and perspectives on global interdependence that affect the possibilities for social movement activism today. At the same time, anti-democratic forces led mainly by the U.S. government have sought to preserve existing relations of domination and exploitation against the latest movement challenges. The current “war on terror” serves to mask a longer-term effort by proponents of economic globalization to restrict public opposition to their agenda. I outline some of the key reactions that the U.S. and other Western governments have taken in response to movement challenges, and I suggest several lessons this analysis uncovers for how activists—primarily those in the U.S. and other Western countries—can work to enhance the struggle for a more democratic global system.

4. Governing Global Finance: Financial derivatives, liberal states and transformative capacity

Abstract:
Global finance is simultaneously one of the most globalized and one of the most esoteric sectors in the world economy. Within global finance, perhaps no activity is more esoteric and more difficult to understand than the buying and selling of derivatives. Their names are familiar perhaps – futures, options, forwards, swaps – but their nature is obscure. Simply put, derivatives are financial instruments that are used to hedge risk. If a Canadian corporation knows that it will want to buy 50 million US dollars on foreign exchange markets in three months time, it can arrange a fixed price for that purchase using a financial contract called a derivative. In doing so, it lowers the risk of the price of the currency changing drastically before it purchases the amounts it needs.

Abstract:
Old-world ideas accompanied European migrants, and a few changed the globe. An English obsession with landed property was implanted in settlement colonies, so that, between the late 1600s and late 1800s, private initiatives and official planning on British colonial and American frontiers interacted to frame property rights to extensive regions. This paper dwells on that interaction and the tensions between private goals and state sovereignty. The state was essential for framing property rights when these were associated with land and in situ resources. In very recent times, property rights have fostered entirely new industries, for example in software and genetically modified biota. Property rights have changed traditional activities such as art and entertainment. Do new forms of property - "less constrained by physical location" - leave the state with a reduced role in the realm of property rights? Does the paradigm of evolving property rights seen in previous centuries suggest any parallels with struggles over more recent property rights? These are questions for members of the institute to consider. We will offer several concluding thoughts.

6. Private Governance and Democracy in International Finance

Abstract:
The governance arrangements in international finance mirror, in part, those found domestically by featuring a partnership between relatively autonomous state agencies and private actors. Where they depart from domestic arrangements is in the relatively stronger position of private actors, particularly global financial conglomerates, in decision-making. Given the importance of the governance arrangements in international finance for the welfare of individuals and firms throughout the world, it is important to ask whether these arrangements conform to accepted criteria for democratic decision-making. Five criteria are identified that might be applied to international sites of governance. These criteria are then applied to three groups of institutions, the Bank for International Settlements (BIS), the International Organisation of Securities Commissions (IOSCO), and “private regimes” especially predominant in the derivatives subsector. Based on this analysis, important gaps are found when these governance institutions are held up to democratic principles.

Abstract:
The Asian financial crisis has re-opened the debate about the role of the state in the region's industrialisation. Just when there seemed to be growing acknowledgment across the economic and political disciplines that certain kinds of state involvement were vital to the rapid upgrading of the Northeast Asian economies and that understanding what made states effective or ineffective was a crucial issue, along came the financial hurricane. Profound disarray of an economic and social nature has been the most immediate and important consequence of this watershed event. Theoretical disarray has followed closely in its path. This paper seeks to inject some theoretical rigour into the discussion of the Asian crisis. State power in the Asian setting - whether and in what way the state's transformative capacity is weak or robust - and how it relates to the impact of international markets is central to the argument that follows.

Abstract:
The advance of globalization has involved additional governance capacity at supranational levels and thereby raised concerns about democracy, which has traditionally been based on the nationstate. For the most part, these governance arrangements take the form of intergovernmental fora, where nation-states are the principal players. In some policy areas where globalization is more pronounced, such as international finance, governance appears to feature some autonomous institutional development. Autonomy may come in the form of a relatively strong international organization with a mandate anchored in international law such as the World Trade Organization (WTO), or of the institutionalization of norms and values that give the intergovernmental forum an autonomous and distinct global perspective. As Held (1995) has observed, democratic theory has assumed that the nation-state is the relevant decision-making unit. The migration of political authority to supranational levels thus has the potential to undermine long-standing democratic arrangements.
