311. The Intersection between Justice and Home Affairs and the European Neighbourhood Policy: Taking Stock of the Logic, Objectives and Practices

Abstract:
This paper claims that the European Neighbourhood Policy (ENP) of the EU, and in particular the elements related to justice and home affairs (JHA), is a complex, multilayered initiative that incorporates different logics and instruments. To unravel the various layers of the policy, the paper proceeds in three steps: firstly, it lays out some facts pertaining to the origins of the ENP, as its 'origins' arguably account for a number of the core tensions. It then presents the underlying logic and objectives attributed to JHA cooperation, which can be derived from the viewpoints voiced during policy formulation. The paper goes on to argue that despite the existence of different logics, there is a unifying objective, which is to 'extra-territorialise' the management of 'threats' to the neighbouring countries. The core of the paper presents the various policy measures that have been put in place to achieve external 'threat management'. In this context it is argued that the 'conditionality-inspired policy instruments', namely monitoring and benchmarking of progress, transfer of legal and institutional models to non-member states and inter-governmental negotiations, contain socialisation elements that rely on the common values approach. This mix of conditionality and socialisation instruments is illustrated in two case studies, one on the fight against terrorism and one on irregular migration. Finally, the paper recommends that the EU draft an Action-Oriented Paper (AOP) on JHA cooperation with the ENP countries that indicates how the EU intends to balance the conflicting objectives and instruments that are currently present in the JHA provisions of the ENP.

Abstract:
The EU has increasingly committed itself to fusing security and development. Developmental approaches to security are routinely seen as integral to the EU's distinctive foreign policy identity. This paper finds, however, that much work remains to be done to implement this commitment. Few in the EU would doubt that development and security go hand in hand, but differences abound over what this implies for the allocation of finite resources and the nature of diplomatic engagements.

313. Bubbles in real estate? A Longer-Term Comparative Analysis of Housing Prices in Europe and the US

Abstract:
The downturn in the US housing market has attracted a lot of attention as it has sparked a global financial crisis. It is generally assumed that the eurozone does not face a similar problem. This paper shows that this assumption is wrong. The euro area average index of real housing prices has risen almost as much as that of the US and is now (as that of the US) about 40% above its 30-year average. This is similar to the overvaluation of Japanese real estate at the height of the Japanese bubble, which was then followed by over a decade of continuous decline. Over the last 30 years, the euro area index for real housing prices has tended to follow that of the US quite closely. The lag is now much shorter than in the 1970s or 1980s. The euro area market is thus likely to turn soon as well. One feature of housing price cycles that tends to be forgotten is their extraordinary length: many last for more than ten years. This persistence means that the downswing, which now seems to have started, is likely to last at least until the next decade. Within the euro area, there are large divergences: cases of 'froth' (Spain, for example) co-exist alongside cases of declining prices (Germany). These divergences have persisted for over a decade and have led to important macroeconomic disequilibria. The paper also develops an indicator of 'housing overhang', which shows by how much demand for new construction has to decline to bring the supply of housing back to normal levels. This indicator suggests that there is virtually no housing overhang in the eurozone on average and that it is of a manageable magnitude in the US. Spain and Ireland, however, face a massive housing overhang and thus probably a sharp deceleration of construction demand.

314. EU Policy in the South Causasus: A View from Azerbaijan

Abstract:
Since the accession of Romania and Bulgaria to the EU in January 2007, the South Caucasus has become a region of direct concern to the EU's strategy in its wider neighbourhood. This study examines the trends affecting EU policies in the South Caucasus, with a specific focus on EU–Azerbaijan relations. It argues that in the three main areas in which Azerbaijan affects Europe's interests – cooperation in the energy sector, democratisation and conflict resolution – so far the EU has engaged well on a regional energy strategy, but less so on democratic reforms and almost not at all on conflict settlement in Nagorno Karabakh. The study concludes that the EU needs to balance its involvement in all three areas, especially given the deeper democratic changes it wishes to see in Azerbaijan, with a list of recommendations for doing so.

Rarely has an EU Presidency been met with such high expectations as Germany's in the first half of 2007. With hindsight, it might be said that these expectations have largely been fulfilled. The agreement on a detailed mandate for the upcoming Intergovernmental Conference (IGC) under the Portuguese Presidency now offers a way forward for a Union that has been 'in crisis' since the French and Dutch no-votes. This report offers an overview of the German Presidency's aims in the various policy areas and makes an assessment of the achievements of its six-month term. A summary of the content and structural background of German EU policy is given, explaining developments since unification, Germany's motivations for European integration, public opinion on European integration and the stances taken by the key political players in Germany. Insight into the organisational structures of the Presidency appears in the annex.

316. Fake, Partial and Imposed Compliance: The Limits of the EU's Normative Power in the Western Balkans

This paper examines the EU's external power through the prism of perceptions by non-EU countries of the aims of EU foreign policies, as shown in the Western Balkans. The paper argues that the EU's policy in the Western Balkans lacks a strong normative justification, which affects the degree of compliance with the EU's demands in areas related to state sovereignty. The perceived lack of legitimacy opens up political space for domestic actors to contest the positions taken by the EU on normative grounds. The Western Balkan countries have responded by giving preference to internal sources of legitimacy and asserting domestic reasons for fake compliance, partial compliance or non-compliance with the EU's conditions, with the latter provoking imposed compliance. The EU's transformative leverage in the region has been much weaker to date in comparison with that in Central and Eastern Europe prior to EU accession.

Abstract:
Islamist parties in Morocco have seen an ideological transformation from a radical – even violent – political doctrine to a more pragmatic and progressive strategy in recent years. This paper seeks to understand how the internal ideological evolution of Moroccan Islam and the international context have made collaboration with Europe and the US possible. The key Islamist players on the Moroccan political stage are the Party of Justice and Development and the Association for Justice and Charity, both of which have shown a desire to increase cooperation with Europe but this, they claim, has not been reciprocated by the EU.

Syria is almost unique among Arab states in that the only variant of political Islam to be found here is state–sanctioned. This paper observes how the trends, tendencies and central figures of political Islam in Syria have positioned themselves with regard to relations with Europe, the Euro-Mediterranean Partnership and European Neighbourhood Policy. Based on a series of (anonymous) interviews with both 'independent' and more government-linked sources, Salam Kawakibi traces the evolution of political Islam in Syria, the growth of civil society agitation and the revival of practices of faith in this country. No party, no organisation and no individual within the country can claim to be both a representative of political Islam and independent, states this author in exile.

Since the end of the cold war until 2004, the United States and the European Union held largely complementary views towards the European neighbourhood. Washington's foreign policy mantra was that of a Europe 'whole and free', where the dividing lines inherited from the cold war were to dissolve through the gradual inclusion of Central and Eastern Europe in the Euro-Atlantic family of nations. The EU concomitantly focused on its enlargement strategy, which ensured that the transition of the former communist countries would be benchmarked and monitored, in order to attain the ultimate goal of their full integration into the EU.

Abstract:
Drawing on results from a survey among members of the Muslim Brothers and the Wasat Party, Emad El- Din Shahin, Professor at the American University in Cairo and Harvard University, looks at changes in Egyptian political Islam and examines the views of mainstream Islamists of the European Union polices and initiatives in the Mediterranean. The discussion focuses on the Muslim Brothers, the country's main opposition force, and the Wasat Party, as purporting to represent an evolving Islamic centrist orientation. Despite their seemingly different orientations, the commonalities between the two groups regarding their views of the EU far outweigh their differences. Their shared Islamic frame of reference and a perceived inconsistency of EU policies in the region largely explain this similarity.
