1. Building Blocks and Challenges for the Implementation of the Global Compact on Refugees in Africa

Abstract:
Forced displacement continues to be a major challenge to human security across the globe. According to the United Nations High Commissioner for Refugees (UNHCR), the global population of forcibly displaced people increased by 2.3 million people in 2018, and by the end of the year, more than 70 million individuals were forcibly displaced worldwide (UNHCR 2019a). UNHCR also estimated that, in 2018, 13.6 million people were newly displaced as a result of conflicts and droughts (ibid.). Building on the predicament of global sustainability and the 2030 agenda for sustainable development, the Global Compact on Refugees (GCR) is a framework based on four strategic objectives: to (1) ease pressures on host countries, (2) enhance refugee self-reliance, (3) expand access to third-country solutions, and (4) support conditions in countries of origin for return in safety and dignity (UNHCR 2018; UN General Assembly 2019). The GCR urges the international community to respond comprehensively and innovatively to the plight of refugees, and to make a paradigm shift in global humanitarian aid to emphasize refugee self-reliance and livelihoods. One of the risks of such a nonbinding and thin agreement, however, is that the GCR will give rise to a bureaucratic process that “does not come even close to dependably addressing the operational deficits of the refugee regime” (Hathaway 2019, 594). This article looks closely at the prospects for the GCR in sub-Saharan Africa based on the need to shift from a humanitarian system of “care and maintenance” to comprehensive and effective development responses to refugee crises. It also discusses some of these experiences and best practices to promote a resilience-based development approach. It recognizes that development initiatives implemented or still to be implemented under the normative framework of the GCR and the Comprehensive Refugee Response Framework (CRRF) are subject to a multiyear planning and implementation cycle. Therefore, this article does not intend to evaluate their efficacy or measure progress under the GCR, but rather to identify key challenges and to highlight achievements and promising initiatives in sub-Saharan Africa. It particularly focuses on implementation and rollout of the CRRF in Chad, Djibouti, Ethiopia, Kenya, Rwanda, Somalia, Uganda, and Zambia in Africa.

2. The purpose of this study was to ascertain the challenges faced by Central American migrants who returned home after failing to gain asylum or other international protection in the United States or Mexico. Cristosal interviewed individuals who fled from El Salvador, Guatemala, and Honduras under threats of violence and persecution and had been deported back to their country of origin to determine why they fled their homelands, why they could not secure asylum, and on their situations post-return. In the context of mass migration from these countries, the study used in- depth interviews to understand the different ways in which people experienced the violence and fear that forced them to flee and how their responses upon “voluntary return” or deportation back to their country of origin were shaped by that same violence. While there are many studies on the flight of persons from the Northern Triangle of Central America (NTCA), little is known about the experience of refugees who cannot secure protection in another country and are deported to their home country, from which they originally fled. What are the psychosocial, security, and human rights consequences for people who migrated out of fear for their lives and were then forced to return to the situation that forced them to flee?

The US refugee resettlement program should be a source of immense national pride. The program has saved countless lives, put millions of impoverished persons on a path to work, self-sufficiency, and integration, and advanced US standing in the world. Its beneficiaries have included US leaders in science, medicine, business, the law, government, education, and the arts, as well as countless others who have strengthened the nation’s social fabric through their work, family, faith, and community commitments. Refugees embody the ideals of freedom, endurance, and self-sacrifice, and their presence closes the gap between US ideals and its practices. For these reasons, the US Refugee Admissions Program (USRAP) has enjoyed strong, bipartisan support for nearly 40 years. Yet the current administration has taken aim at this program as part of a broader attack on legal immigration programs. It has treated refugees as a burden and a potential threat to our nation, rather than as a source of strength, renewal, and inspiration. In September 2017, it set an extremely low refugee admissions ceiling (45,000) for 2018, which it had no intention of meeting: the United States is on pace to resettle less than one-half of that number. It has also tightened special clearance procedures for refugees from mostly Muslim-majority states so that virtually none can enter; cynically slow-walked the interview, screening, and admissions processes; and decimated the community-based resettlement infrastructure built up over many decades (Miliband 2018). At a time of record levels of forced displacement in the world, the United States should model solidarity with refugees and exercise leadership in global refugee protection efforts (Francis 2018a, 102). Instead, the administration has put the United States on pace to resettle the lowest number of refugees in USRAP’s 38-year history, with possible further cuts in fiscal year (FY) 2019.

Abstract:
There is a consensus among global policymakers that the challenges facing refugees today arise, in no small part, from the treatment of forced displacement as predominately a short-term humanitarian problem and the consequent exclusion of refugees from long-term development assistance. This paper agrees that refugees — a majority of whom spend years, a large number decades, some lifetimes in exile — constitute a development challenge, not only a humanitarian one. But it departs from the prevailing consensus which has tended to underemphasize the historical role of certain development policies in contributing to the status quo of refugee poverty in the first place. The paper places particular emphasis in that regard on policies of austerity and of laissez-faire. In their stead, it argues in favor of approaches to development that are proactively egalitarian and redistributive.

4. DREAM Act-Eligible Poised to Build on the Investments Made in Them

Abstract:
This paper presents the results of a study by the Center for Migration Studies (CMS) on potential beneficiaries of the DREAM Act of 2017 (the “DREAM Act” or “Act”). The study reveals a long-term, highly productive population, with deep ties to the United States. In particular, it finds that: More than 2.2 million US residents would qualify for conditional residence under the DREAM Act. An additional 929,000 — who are now age 18 and over — arrived when they were under 18, but have not graduated from high school and are not enrolled in school and, thus, would not currently qualify for status under the Act. The DREAM Act-eligible can be found in large numbers (5,000 or more) in 41 states and more than 30 counties, metropolitan areas, and cities. Potential DREAM Act recipients have lived in the United States for an average of 14 years. Sixty-five percent (age 16 and above) participate in the labor force, with far higher rates in Wisconsin, Massachusetts, Utah, Arkansas, Illinois, Tennessee, and Oregon. This population works heavily in sales and related occupations; food preparation and serving; construction and extracting; office and administrative support; production; transportation and material moving; and building/grounds cleaning and maintenance. Many of the DREAM Act-eligible are highly skilled and credentialed. 70,500 are self-employed. Eighty-eight percent speaks English exclusively, very well, or well. 392,500 have US-citizen children, and more than 100,000 are married to a US citizen or lawful permanent resident. Twenty-nine percent has attended college or received a college degree. The DREAM Act-eligible include 50,700 Temporary Protected Status (TPS) recipients from El Salvador, Haiti, and Honduras, 45 percent of whom live in the Miami metro area, Los Angeles County, the Washington, DC area, Houston, New York City, the San Francisco metro area, and the City of Dallas. The study also underscores the immense investment — $150 billion — that states and localities have already made in educating these young Americans. It argues that over time and with a path to citizenship the return on this investment will increase by virtually every indicia of integration — education levels, employment rates, self-employment numbers, US family members, and English language proficiency.

This report describes the myriad ways in which this program serves US interests and values. The program: saves the lives of the world’s most vulnerable persons; continues “America’s tradition as a land that welcomes peoples from other countries” and shares the “responsibility of welcoming and resettling those who flee oppression” (Reagan 1981); promotes a “stable and moral world” (Helton 2002, 120); reduces spontaneous, unregulated arrivals and encourages developing nations to remain engaged in refugee protection (Gammeltoft-Hansen and Tan 2017, 42-43); and promotes cooperation from individuals, communities, and nations that are central to US military and counter-terrorism strategies.[1] In that vein, the report describes the achievements, contributions, and integration outcomes of 1.1 million refugees who arrived in the United States between 1987 and 2016. It finds that: the median household income of these refugees is $43,000;[2] 35 percent of refugee households have mortgages; 63 percent of refugees have US-born children; 40 percent are married to US citizens; and 67 percent have naturalized. Comparing the 1.1 million refugees who arrived between 1987 and 2016 with non-refugees,[3] the foreign born, and the total US population, the report finds: Refugees’ labor force participation (68 percent) and employment rates (64 percent) exceed those of the total US population (63 and 60 percent respectively).[4] Large numbers of refugees (10 percent) are self-employed and, in this and other ways, job creators, compared to 9 percent for the total US population. Refugees’ median personal income ($20,000) equals that of non-refugees and exceeds the income of the foreign born overall ($18,700). Refugees are more likely to be skilled workers (38 percent) than non-refugees (33 percent) or the foreign born (35 percent). Refugees are less likely to work in jobs that new immigrants fill at high rates, such as construction, restaurants and food service, landscaping, services to buildings and dwellings, crop production, and private households. Refugees use food stamps and Medicaid at higher rates than non-refugees, the foreign born, and the total US population. However, their public benefit usage significantly declines over time and their integration, well-being, and US family ties increase. Comparing refugee characteristics by time present in the United States — from the most recent arrivals (2007 to 2016), to arrivals between 1997 to 2006, to those with the longest tenure (1987 to 1996) — the report finds: Refugees with the longest residence have integrated more fully than recent arrivals, as measured by households with mortgages (41 to 19 percent); English language proficiency (75 to 55 percent); naturalization rates (89 to 24 percent); college education (66 to 32 percent); labor force participation (68 to 61 percent); and employment (66 to 55 percent) and self-employment (14 to 4 percent). Refugees who arrived from 1997 to 2006 have higher labor force participation and employment rates than refugees who arrived from 1987 to 1996.[5] Refugees who arrived between 1987 and 1996 exceed the total US population, which consists mostly of the native-born, in median personal income ($28,000 to $23,000), homeownership (41 to 37 percent with a mortgage), percent above the poverty line (86 to 84 percent), access to a computer and the internet (82 to 75 percent), and health insurance (93 to 91 percent). Comparing nationals — in 2000 and again in 2016 — from states formerly in the Soviet Union, who entered from 1987 to 1999, the report finds that: median household income increased from $31,000 to $53,000; median personal income nearly tripled, from $10,700 to $31,000; the percent of households with a mortgage increased from 30 to 40 percent; public benefit usage fell; English language proficiency rose; the percent with a college degree or some college increased (68 to 80 percent); naturalization rates nearly doubled, from 47 to 89 percent; marriage to US citizens rose from 33 to 51 percent; and labor force participation rate (59 to 69 percent), employment (57 to 66 percent), self-employment (11 to 15 percent), and the rate of skilled workers (33 to 38 percent) all grew. The report also finds that refugees bring linguistic diversity to the United States and, in this and other ways, increase the nation’s economic competitiveness and security. In short, refugees become US citizens, homeowners, English speakers, workers, business owners, college educated, insured, and computer literate at high rates. These findings cover a large population of refugees comprised of all nationalities, not just particularly successful national groups. Section I of the report describes the nation’s historic commitment to refugees and critiques the administration’s rationale for dismantling the resettlement program. Section II sets forth the Center for Migration Studies (CMS) methodology for selecting the refugee data used in this report. Section III discusses the resettlement, national origins, and years of arrival of the refugees in CMS’s sample. Section IV details the report’s main findings on the achievements, contributions, and integration of refugees over time. It compares the characteristics of refugees, non-refugees, the foreign born, and the total US population; and examines the progress of refugees — measured in 2000 and 2016 — that arrived from the former Soviet Union between 1987 and 1999. This section also references the growing literature on the US refugee program and on the economic and fiscal impacts of refugees. Section V discusses the important role of voluntary agencies in the resettlement process, focusing on the work of Catholic agencies in building community support for refugees and promoting their entrepreneurial initiatives. Section VI identifies the national interests served by the refugee program, recommends ways to address several of the program’s longstanding challenges, and urges the president, Congress, Americans with refugee roots, and other stakeholders to work to strengthen and expand the program.

6. Communities in Crisis: Interior Removals and Their Human Consequences

Abstract:
In late 2017, the Kino Border Initiative (KBI), the Center for Migration Studies of New York (CMS), and the Office of Justice and Ecology (OJE) of the Jesuit Conference of Canada and the United States initiated a study to examine the characteristics of deportees and the effects of deportation, and to place them in a broader policy context (see Attachment A in the Supplemental Material, available in the online version of this article).[1] The CRISIS Study (Catholic Removal Impact Survey in Society) included both quantitative and qualitative elements. During the first five months of 2018, KBI staff surveyed 133 deportees from the United States at its migrant shelter in Nogales, Sonora. Survey respondents were all Mexican nationals, all but one were men, and each had been living for a period of time in the United States.[2] They had resided in 16 US states, the majority in Arizona, followed by Nevada, California, and Utah. The survey sought information on their US lives, the removal and detention process, and the impact of removal on them and their families (see Attachment B in the Supplemental Material, available in the online version of this article). The study also included one interview with a deportee (via Skype) and 20 interviews with the family members of deportees and other persons affected by deportation in Catholic parishes in Florida, Michigan, and Minnesota. The parishes — which the report will not identify in order to ensure the interviewees’ anonymity — were chosen based on their geographic, demographic, and sociopolitical diversity, their connections to the agencies conducting the study, and their ability to facilitate access to deportees, their families, and others impacted by deportation. The interviews explored: (1) the impact of removals on deportees, their families, and other community members; (2) the deportation process; and (3) the relationship between deportees and their families (see Attachment C in the Supplemental Material, available in the online version of this article). They provided an intimate, often raw look at the human consequences of deportation.

7. Immigration Policy and Agriculture: Possible Directions for the Future

Presidential candidate Trump in 2016 promised to prevent unauthorized migration and deport unauthorized foreigners in the United States, and President Trump issued executive orders after taking office in January 2017 that could lead to a 2,000-mile wall on the Mexico-US border and the removal of many of the 11 million unauthorized foreigners, including one million who work in US agriculture. This paper emphasizes that, especially agriculture in the western United States, has long relied on newcomers to fill seasonal farm jobs. The slowdown in Mexico-US migration since 2008-09 means that there are fewer flexible newcomers to supplement the current workforce, which is aging and settled. Farm employers are responding by offering bonuses to satisfy current workers, stretching them with productivity-increasing tools, substituting machines for workers, and supplementing current workforces with legal H-2A guest workers. Immigration policy will influence the choice between mechanization, guest workers, and imports. Several factors suggest that the United States may be poised to embark on another large-scale guest worker program for agriculture. If it does, farmers should begin to pay Social Security and Unemployment Insurance (UI) taxes on the wages of H-2A workers to foster mechanization and development in the workers’ communities of origin by dividing these payroll taxes equally between workers as they depart and commodity-specific boards. Worker departure bonuses could be matched by governments in migrant-sending areas to promote development, and commodity-specific boards could spend monies to reduce dependence on hand labor over time. The economic incentives provided by payroll taxes could help to usher in a new and better era of farm labor.

8. You are Not Welcome Here Anymore: Restoring Support for Refugee Resettlement in the Age of Trump

After descending an escalator of his hotel at Central Park West on a June day in 2015, Donald Trump ascended a podium and proceeded to accuse Mexico of “sending people that have lots of problems, and they’re bringing those problems with us (sic). They’re bringing drugs. They’re bringing crime. They’re rapists” (Time 2015). It was a moment that marked the launch of his bid for president of the United States. From that point forward, Trump made immigration restriction one of the centerpieces of his campaign. Paired with an economically populist message, the nativist rhetoric shaped a narrative that helped launch him to the White House. His effectiveness partly lay in his ability to understand and exploit preexisting insecurities, partly in his outsider status, and partly in his willingness to tap into apparently widespread public sentiment that is uneasy with, if not overtly hostile to, migrants. This paper will try to make sense of the restrictionist logic that informs the Trump administration’s worldview, alongside some of the underlying cultural, philosophical, and political conditions that inspired support for Trump by millions of Americans. This paper contends that the Clash of Civilizations (CoC) paradigm is a useful lens to help understand the positions that President Trump has taken with respect to international affairs broadly, and specifically in his approach to migration policy. This paradigm, originally coined by the historian Bernard Lewis but popularized by the political theorist Samuel Huntington (Hirsh 2016), provides a conceptual framework for understanding international relations following the end of the Cold War. It is a framework that emphasizes the importance of culture, rather than political ideology, as the primary fault line along which future conflicts will occur. Whether Trump ever consciously embraced such a framework in the early days of his candidacy is doubtful. He has been candid about the fact that he has never spent much time reading and generally responds to problems on instinct and “common sense” rather than a conceptually defined worldview developed by academics and intellectuals (Fisher 2016). Nevertheless, during the presidential campaign, and continuing after his victory, Trump surrounded himself with high-level advisers, political appointees, and staff who, if they have nothing else in common, embrace something roughly akin to the Clash of Civilizations perspective (Ashford 2016).[1] The paper will focus primarily on Trump’s approach to refugee resettlement. One might think that refugees would elicit an almost knee-jerk sympathy given the tragic circumstances that drove their migration, but perceptions of refugees are often tied up with geopolitical considerations and domestic political realities. Following 9/11, the threat of Islamic-inspired terrorism emerged as a national security priority. With the onset of the Syrian Civil War and the significant refugee crisis that ensued in its wake, paired with some high-profile terrorist attacks in the United States and Europe, the “Islamic threat” became even more pronounced. The perception that Islamic-inspired terrorism is a real and imminent threat has contributed to a growing antagonism toward the resettlement of refugees, and particularly Muslims. When viewed through the lens of the CoC paradigm, victims of persecution can easily be transformed into potential threats. Insofar as Islam is understood as an external and even existential threat to the American way life, the admission of these migrants and refugees could be deemed a serious threat to national security. This paper will begin by examining some of Trump’s campaign promises and his efforts to implement them during the early days of his administration. Although the underlying rationale feeding into the contemporary reaction against refugee resettlement is unique in many respects, it is rooted in a much longer history that extends back to the World War II period. It was during this period that a more formal effort to admit refugees began, and it was over the next half century that the program developed. Understanding the historical backdrop, particularly insofar as its development was influenced by the Cold War context, will help to clarify some of the transitions that influenced the reception of refugees in the decades after the fall of the Soviet Union. Such an exploration also helps to explain how and why a CoC paradigm has become ascendant. The decline of the ideologically driven conflict between the United States and the Soviet Union has, according Huntington’s thesis, been superseded by culturally based conflicts that occur when competing civilizations come into contact. The conceptual framework that the CoC framework embodies meshes well with the cultural and economic dislocation felt by millions of Trump supporters who are concerned about the continued dissolution of a shared cultural and political heritage. It is important to keep in mind that the CoC paradigm, as a conceptual framework for understanding Donald Trump and his approach to refugee resettlement and migration more broadly, is at its core pre-political; it helps to define the cultural matrix that people use to make sense of the world. The policy prescriptions that follow from it are more effect than cause.

9. Separated Families: Barriers to Family Reunification After Deportation

Abstract:
This paper outlines the complexities — and unlikelihood — of keeping families together when facing, or in the aftermath of deportation. After discussing the context that limits or prevents reunification among immigrant families more generally, I outline several of the particular ways that families are divided when a member is deported. Drawing on case studies from longitudinal ethnographic research in Mexico and the United States, I describe: 1) the difficulties in successfully canceling deportation orders, 2) the particular limitations to family reunification for US citizen children when a parent is deported, and 3) the legal barriers to authorized return to the United States after deportation. I argue that without comprehensive immigration reform and concrete possibilities for relief, mixed-status and transnational families will continue to be divided. Existing laws do not adequately address family life and the diverse needs of individuals as members of families, creating a humanitarian crisis both within and beyond the borders of the United States. The paper concludes with recommendations for immigration policy reform and suggestions for restructuring administrative processes that directly impact those who have been deported and their family members.

10. US Immigration Policy and the Case for Family Unity

Abstract:
As the Trump administration contemplates immigration reform, it is important to better understand what works and what does not in the current system. This paper reviews and critically evaluates the principle of family unity, a hallmark of US immigration policy over the past 50 years and the most important mechanism for immigration to the United States. Since 1965, the United States has been admitting a relatively high proportion of family-based migrants and allowing for the immigration of a broader range of family members. However, restrictive annual quotas have resulted in a long line of prospective immigrants waiting outside of the United States or within the United States, but without status. Further policy changes have led to an increasing number of undocumented migrants and mixed-status families in the United States. Several policies and practices contribute to prolonged periods of family separation by restricting travel and effectively locking in a large number of people either inside or outside of the United States. On top of that, increasingly aggressive enforcement practices undermine family unity of a large number of undocumented and mixed-status families. Deportations — and even a fear of deportation — cause severe psychological distress and often leave US-born children of undocumented parents without economic and social support. A recent comprehensive report concluded that immigration has overall positive impact on the US economy, suggesting that a predominantly family-based migration system carries net economic benefits. Immigrants rely on family networks for employment, housing, transportation, informal financial services, schooling, childcare, and old age care. In the US context where there is nearly no federal support for immigrants’ integration and limited welfare policies, family unity is critical for promoting immigrant integration, social and economic well-being, and intergenerational mobility. Given the benefits of family unity in the US immigrant context and the significant negative consequences of family separation, the United States would do well to make a number of changes to current policy and practice that reaffirm its commitment to family unity. Reducing wait times for family reunification with spouses and children of lawful permanent residents, allowing prospective family-based migrants to visit their relatives in the United States while their applications are being processed, and providing relief from deportation and a path to legalization to parents and spouses of US citizens should be prioritized. The cost to implement these measures would likely be minor compared to current and projected spending on immigration enforcement and it would be more than offset by the improved health and well-being of American families.
