11. The Future of U.S. Nuclear Policy: The Case for No First Use

Abstract:
Despite heightened expectations for significant change in U.S. nuclear policy—especially declaratory policy— the Obama administration's Nuclear Posture Review changes little from the past. The NPR's declaratory policy retains the option for the United States to use nuclear weapons first in a variety of circumstances, including in a first strike against Chinese, North Korean, Russian, and (perhaps) future Iranian nuclear forces. Equally important, the United States can threaten the first use of nuclear weapons to deter and, if necessary, respond, to a variety of nonnuclear contingencies, including large-scale conventional aggression by another nuclear power such as China or Russia and chemical or biological weapons (CBW) attacks from states such as Iran and North Korea.

12. Al Qaeda's Religious Justification of Nuclear Terrorism

Abstract:
When legendary jihadist Abdullah Azzam was assassinated under mysterious circumstances in November 1989, suspects in his murder included Osama bin Laden and Egyptian Islamic Jihad (EIJ) leader Ayman al-Zawahiri. After the Soviets were expelled from Afghanistan, Azzam sought to shift jihad to his homeland, Palestine. Zawahiri sought to focus the jihad on Egypt and the other secular Muslim states, in hopes of restoring the caliphate, the rule of Islamic clerics, which had ended after the dissolution of the Ottoman Empire in 1924. After Islamic rule had been re-established in the Islamic world, Zawahiri wrote, “then history would make a new turn, God willing, in the opposite direction against the empire of the United States and the world's Jewish government.”

13. Controlling Behavior – Not Arms: Moving Forward On An International Convention For Cyberspace

Abstract:
The rapidly increasing occurrence of cyber attacks and the growing use of the cyber domain for politically motivated purposes during both times of war and peace by both state and non-state actors has precipitated a dire need of an international convention to control behavior in cyberspace. While arms control conventions exist for the nuclear, chemical, and biological modes of warfare occurring at land, sea, space, and air, no such treaty is in place for the latest domain, whose tactical importance is now of vital importance for the global communication infrastructure and domestic military capabilities. In this paper, I will first extrapolate upon the current legal landscape pertinent to cyber arms and crime, and explore the limitations of current international laws that have been most often cited during past instances of cyber attacks. I will further explore a number of arms control drafts that have been proposed over the years, and highlight some of the lessons learned, with the aim of providing a constructive analysis to aid international lawmakers and affiliated institutions who are less familiar with the meta-physical cyber domain, and the unique challenges it presents. Finally, I will analyze the following five essential elements of a future global cyber convention: terms and definitions regarding cyber arms; peaceful use of cyber technology; signatory obligations regarding private actors; attribution; and mechanisms for deterrence. In exploring these fundamental themes, I will demonstrate why and how a future convention for cyberspace should focus on controlling behavior, rather than dwelling on a counterproductive goal of arms control.

Abstract:
If the agreed objective of complete denuclearization of Korean peninsula is to be achieved, it can be expected that dismantling and ultimately decommissioning North Korean plutonium production facilities have to be proceeded. This paper will focus on decommissioning the 5 megawatt-electric (MWe) plutonium production reactor and the reprocessing plant. It explores and recommends the best decommissioning approaches to those nuclear facilities. It also provides a discussion of the decommissioning costs for these nuclear facilities.

15. Funding for U.S. Efforts to Improve Controls Over Nuclear Weapons, Materials, and Expertise Overseas: A 2009 Update

Abstract:
The Obama administration is still developing a plan to ensure effective security for all nuclear weapons and weapons-usable nuclear material worldwide within four years, as President Obama outlined in his Prague speech. Because the plan is still in development, the additional funding to implement such an effort was not included in the “steady as you go” fiscal year (FY) 2010 budget request sent to Congress in early May 2009. The $1.3 billion request for programs to improve controls over nuclear weapons, materials, and expertise overseas is essentially the same as the FY 2009 appropriation and $30 million less than the FY 2008 appropriation. The request for all threat reduction programs (including chemical, biological, and missile-related programs as well as nuclear programs) is approximately $1.6 billion, a slight decline from the FY 2009 appropriation. As Kenneth Luongo, president of the Partnership for Global Security, put it in an April 2 press release: “The budget request for FY 2010 needs to be significantly increased across the board if there is any hope of meeting the President's high pri-ority WMD proliferation prevention goals. A stagnant or modestly increased funding profile will be inadequate and amount to business as usual.” If the four-year target is to be achieved, the administration and Congress will need to work together to ensure that these efforts are not slowed by lack of funds.

16. Beyond Zero Enrichment: Suggestions for an Iranian Nuclear Deal

Abstract:
The United States and the other members of the P5+1 are struggling to launch the first in-depth negotiations with Iran over its nuclear program in which the United States has participated. The United States comes to the table with few good options. Sanctions have failed to change Iran's decisions about its nuclear program, and no feasible set of sanctions (given the limits of what China, Russia, and others will agree to) is likely to convince Iran to give up its enrichment program. Military strikes against Iran would probably not set back Iran's program for longer than a brief period and would greatly increase Iran's incentive to go straight to the bomb at covert sites (as Iraq did after Israel destroyed its facilities at Osiraq).

Abstract:
In the past year, there has been notable progress in ensuring that stockpiles of the essential ingredients of nuclear weapons around the world are secured from theft and transfer to terrorists. But there remains a dangerous gap between the pace of progress and the scope and urgency of the threat – a gap that, if left unfilled, could lead to unparalleled catastrophe. We must close the gap – to take action now that, within a few years, could reduce the danger that terrorists might turn the heart of a U.S. city into a new Hiroshima to a fraction of what it is today. This paper is intended to outline the continuing threat; summarize the progress made in addressing it in the past year, and the gaps that still remain; and recommend steps to close the gap between threat and response. The terrorists who have sworn to kill Americans wherever they can be found have undertaken an intensive effort to get a nuclear bomb, or the materials and expertise needed to make one. We need to be racing as fast as we can to stop them before they succeed. This paper is about steps to win that race.

The higher phase of nuclear conflict means the use of nuclear weapons at various scales—from single nuclear explosions to the mass use of nuclear weapons.
