51. The Economic Dimension of the Czech Foreign Policy

Abstract:
In 2017, the domestic support of the Czech Republic’s external economic relations (EER) maintained its continuity and corresponded with the recent developments in the world economy and the EU’s proactive policies in the internal market. It derived from the recent updates of the Export Strategy of the Czech Republic for 2012–2020 and the Map of Global Export Opportunities 2016/17 and profited from the improved relations between the relevant stakeholders and their ever-extending activities as well as newly introduced export and investment promotion tools. The period was successful in terms of performance as the Czech Republic achieved both an extraordinary increase in exports and a remarkable rate of GDP growth. This was combined with a growing emphasis on sustainable development. On the other hand, several questions relating to the institutional architecture remained. The adaptation of the system to the needs of a 21st century small open economy will be a challenge, and its possible failure one of the main risks in the future.

Abstract:
In 2017, the Czech Republic focussed mainly on the issue of strengthening energy security, both within the EU and the V4, and bilaterally in its relations with Germany, Austria, Russia, USA and France. In this context, the politicisation of the Czech discourse regarding the external dimension of energy security has been rather limited. Similarly, the polarisation of the Czech external dimension of the energy security discourse has also been limited. Despite this, the Czech government has relatively successfully tried to maintain a unified position in its energy policies, which is why in this case we can talk about a coherence within time, and across different players, as well as through the declared priorities of both the government and the EU. Last, but not least, the Czech Republic was supportive of creating common policies based on its proactive approach and co-operative position. The Czech Republic also adapted to external politics in the area of energy – which was the result of its reactive approach and neutral position.

Abstract:
In 2017, the Czech Republic went through the third round of the Universal Periodic Review and, for six months, it assumed the chairmanship in the Committee of Ministers of the Council of Europe, the main European human rights organisation. These events might help promote the Czech human rights foreign policy both inside and outside the country. Yet, they were largely overshadowed, first, by the crisis in the government coalition, and, later on, by the parliamentary elections. The elections, resulting in the victory of Andrej Babiš’s ANO and the defeat of virtually all the traditional political parties, heralded potential changes in the Czech human rights foreign policy. Yet, since so far, ANO has been rather ambiguous in its approach to human rights, it is not easy to predict what direction such changes may take.

Abstract:
Following the European Year for Development 2015 and the transitional year 2016, 2017 promised to be the year when the Czech development agenda would find a new direction thanks to the introduction of a comprehensive sustainable development framework, new strategic documents, increases in funding and the evolution of the development institutions. Looking back, however, we can safely say it did not happen. While the new framework and strategies have been put in place and the institutions are evolving accordingly, most of the political scene seems to have once again lost interest in the agenda, or even question its utility. Amid growing pragmatism and polarisation, the main question increasingly faced by the Czech development policy is not whether and how it should relate to other dimensions of foreign policy (be it security, migration or business promotion), but rather whether, and to what extent, it will remain one of the country’s pursuits and priorities.

In the field of Czech public diplomacy, the year 2017 did not represent an exceptional year that would bring new major topics or changes. It can be characterised as a transition period from a situation of instability and maybe even uncertainty about the future and leadership of the most visible actor of Czech cultural diplomacy – the Czech Centres (CC). In the second half of the year, however, we may identify new positive ways of strategic thinking about their future. 2017 also saw a continuous trend in the diversification of fields and practices in public diplomacy areas where new forms of diplomatic practice and fields of activity gained a greater place and more attention, such as sports diplomacy. Last, but not least, the Czech public diplomacy has remained dominated by a pragmatic view prioritising the economic potential of various public diplomacy activities without a stronger support for a longer-term vision.

Abstract:
This manuscript originates from research initiated in 2010 at the University of Vigo in International Private Law with a specific focus on International Investment Law. The objective was to analyze the impact of the new paradigm of sustainability on this sphere of the law, with an emphasis on developing countries, and more specifically Cuba. This line of research has resulted in several publications intended for a Spanish-speaking scientific-juridical audience. Yet there is no scholarly work directly aimed at US investors as a prioritized target group. Being the first single Foreign Direct Investor in the world, and given its geopolitical and economic proximity, the US is bound to play a prime role in the field of investments in Cuba—despite political complications. As a consequence, we opted for a bilingual monograph on this topic with a dual purpose. The first part of the book, which is aimed at reaching a wide audience, examines the role played by foreign investment in Cuba and the country’s interest in attracting it by providing investors with a modern, stable, and coherent legal framework that is in line with current international standards. The second part of the book delves into specific technicalities of international investment law— with an emphasis on the conflict resolution system, which finds in arbitrage its main mechanism. This part, technical in nature, is not directly aimed at potential investors as much as their legal advisers, legal firms, arbitrators, and specialized scholarly communities—without whose input the success of foreign direct investment would be impossible. The text also engages critically with the specificities of US-Cuba relations in the context of Foreign Direct Investment. As shown in the first part of this monograph, it seems clear that the strategies pursued by different US administrations have thus far failed. It would be to the US’ benefit to forego the current policy of confrontation in favor of one of cooperation, as exemplified by the approaches taken by Latin America, xiv Europe, and Canada. The US should not lag, if it wants to attain a strategic position in the global repositioning toward the developing Cuban market. There is a need for targeted diplomatic and legislative efforts aimed at strengthening cooperation between the two countries in terms of investment. Among the challenges is the absence of a Bilateral Investment Treaty (BIT) between Havana and Washington. The obstacles faced by the Trump administration in the political, diplomatic, and financial sphere indicate that excessive isolationism and protectionism are not only counterproductive from a financial viewpoint, but they also imply for the US a loss of sovereignty and a diminished capacity to influence the international context. Should the US not change its current policy, it will be outperformed by other international actors such as the European Union and the BRICS (Brazil, Russia, India, and China) as investors in Latin America and in Cuba.

Abstract:
As the primary agency for law enforcement, the police operates at close proximity to the public and exerts significant influence over the security of individuals and communities through its behaviours and performance. Therefore, ensuring accountability of both the individuals and institutions of the police is a fundamental condition for good governance of the security sector in democratic societies. The parliament, as the highest representative body in a democratic system, plays a significant role in maintaining police accountability. The objective of the edited volume on “The Role of Parliament in Police Governance: Lessons Learned from Asia and Europe” is to put forward good practices and recommendations for improving police accountability, with an emphasis on the strengthening of the role of parliament in police governance. The comparative analysis includes insights and lessons learned from eight country case studies including Belgium, Germany, India, Indonesia, the Netherlands, Philippines, Thailand and the United Kingdom. The findings of the cases studies can be taken into account when analysing and considering options for improving the accountability of the police to parliament as well as strengthening independent oversight bodies and parliament-police liaison mechanisms. However, it must be emphasised that these good practices always need to be adapted to the exigencies of the local context.

60. Japan’s Security Renaissance: New Policies and Politics for the Twenty-First Century

For decades after World War II, Japan chose to focus on soft power and economic diplomacy alongside a close alliance with the United States, eschewing a potential leadership role in regional and global security. Since the end of the Cold War, and especially since the rise of Prime Minister Shinzo Abe, Japan's military capabilities have resurged. In this analysis of Japan's changing military policy, Andrew L. Oros shows how a gradual awakening to new security challenges has culminated in the multifaceted "security renaissance" of the past decade. Despite openness to new approaches, however, three historical legacies—contested memories of the Pacific War and Imperial Japan, postwar anti-militarist convictions, and an unequal relationship with the United States—play an outsized role. In Japan's Security Renaissance Oros argues that Japan's future security policies will continue to be shaped by these legacies, which Japanese leaders have struggled to address. He argues that claims of rising nationalism in Japan are overstated, but there has been a discernible shift favoring the conservative Abe and his Liberal Democratic Party. Bringing together Japanese domestic politics with the broader geopolitical landscape of East Asia and the world, Japan's Security Renaissance provides guidance on this century's emerging international dynamics.
