1. Dysfunctional Institutions, Social Trust, and Governance in Areas of Limited Statehood

Abstract:
Areas of limited statehood where the state is absent or dysfunctional are rarely ungoverned or ungovernable spaces. The provision of rules and regulations as well as of public goods and services – governance – does not necessarily depend on the existence of functioning state institutions. How can this be explained? This article makes two claims. First, we identify functional equivalents to state institutions that fail to govern hierarchically. Second, we focus on informal institutions based on social trust that are endogenous to areas of limited statehood. Personalized social trust among community members enables actors to overcome collective action problems, enhancing the legitimacy of governance actors. The main challenge in areas of limited statehood, which are often characterized by social heterogeneity and deep social and cultural cleavages (particularly in post-conflict societies), is to move from personalized to generalized trust in “imagined communities” despite dysfunctional state institutions. We argue that generalized trust in areas of limited statehood crucially depends on inclusive social identities as an enabling condition for effective and legitimate governance.

2. External State-Building and Why Norms Matter - The European Union's Fight against Corruption in the Southern Caucasus

Abstract:
This paper asks under which conditions the state-building efforts of external actors in areas of limited statehood are likely to be effective. We argue that the legitimacy of the specific norms promoted by external actors among local actors is crucial for their success in strengthening state capacities. International norms need to resonate with the dominant domestic discourse on political reforms. To substantiate our argument, we focus on the European Union's (EU) anti-corruption programs and their implementation in one of the most corrupt regions in the world, the Southern Caucasus. We show that legitimacy can explain why the EU's fight against corruption helped reduce corruption in Georgia but not in Armenia. In both countries, political elites could selectively use anti-corruption programs as an instrument against political opponents using enhanced state capacities to stabilize the incumbent regime. Only in Georgia, however, the fight against corruption was facilitated by sustained domestic mobilization for anti-corruption policies that added pressure on political elites 'from below.'

Abstract:
Research on Europeanization and domestic change has moved south-eastwards and was provided with another real-world experiment when it has meet with Turkey. This paper explores to what extent Europeanization approaches travel to Turkey, which does have a membership perspective that looks, however, ever less credible. The first part outlines the main findings of research on 'External Europeanization' focusing on factors that have limited or at least qualified the domestic impact of the EU in the Central and Eastern European (CEE) and Western Balkan (WB) accession countries. The paper, then, discusses to what extent Europeanization approaches need further qualification when applied to Turkey, which squares on democracy with the Western Balkans (with the exception of Croatia), but whose statehood is less limited. We argue that existing Europeanization approaches, largely, account for the overall moderate degree of Europeanization in Turkey. Yet, selective and differential domestic changes are mostly related to the extent to which EU conditionality helps domestic actors gain or hold political power and push their own political agenda. The paper concludes by summarizing the major implications Turkey's accession to the EU has for Europeanization approaches and discussing why Turkey is not a case sui generis.

Abstract:
In order to foster peace, stability and prosperity in its near abroad, the European Union has invoked the European Neighbourhood Policy that seeks to transform the domestic structures of the Newly Independent States in the post-Soviet space thus building a “ring of friends” that share European norms and principles of democracy, rule of the law, market economy, and good governance. Empirical evidence, however, suggests that the EU's capacity to hit across its borders and to realize its reform agenda seems limited. Moreover, most neighborhood countries appear to be stuck in transition and suffer from serious problems of both weak state capacity and defect democracy. Hence, EU efforts may also bear the danger of unintended and negative effects on the domestic structures of states, as its policies and institutions do not only empower liberal reform coalitions, to the extent that they exist in the first place, but can also bolster the power of incumbent authoritarian and corrupt elites. This paper intends to capture this “dark side of Europeanization” (Schimmelfennig 2007). It thus conceptualizes ENP as a political opportunity structure that provides opportunities and constraints to both supporters and opponents of the European Union's reform agenda. Which of the two ultimately get empowered depends not only on the EU's capacity to push for reforms but also on the pull of domestic actors.

5. From Compliance to Practice: Mining Companies and the Voluntary Principles on Security and Human Rights in the Democratic Republic of Congo

Transnational institutions increasingly commit multinational companies to human rights and social standards on a voluntary basis. Our paper investigates the security practices of multinational companies and whether these comply with the Voluntary Principles on Security and Human Rights. Analysing the case of mining companies in the Democratic Republic of Congo we evaluate the impact of the Principles on local security practices and critically analyse the effects of these practices. We argue that one needs to go beyond compliance studies, which focus on the implementation of formal programs (output) and rule-consistent behaviour (outcome), in order to evaluate corporate governance contributions. We therefore develop a conceptual framework that looks at companies' local security practices, including non-compliant practices, and their effects on local security. Our approach leads to a more differentiated evaluation of the effects of voluntary standards and the potential for corporate governance contributions than much of the literature on business and governance does.

6. Good Governance and Bad Neighbors? The Limits of the Transformative Power of Europe

Abstract:
The EU\'s Eastern Enlargement is considered to be one of the (few) successful experiments of promoting good – both effective and legitimate – governance. By contrast, the EU\'s transformative power appears to be weak or non-existent vis-à-vis its (old) neighbors in the South and its (new) neighbors in the East. Both are not only marked by \'bad governance\' but also lack a (credible) membership perspective. While the Western Balkans and Turkey have made significant progress towards good governance, both with regard to government effectiveness and democratic legitimacy, the European Neighborhood Countries (ENCs) appear to be stuck in transition or never got that far in the first place. Even when the effectiveness of their governance institutions has improved, they remain well behind the other regions and especially their democratic legitimacy is still wanting or even in decline. The paper shows that there is a correlation between an EU membership perspective and the successful transformation of neighboring countries. Therefore, it has been argued that the ineffectiveness of the European Neighbourhood Policy (ENP) is due to the lack of this \'golden carrot\'. However, we argue that the prospects of EU membership stabilizes rather than drives the move towards effective and legitimate governance in candidate countries. Thus, a membership perspective is unlikely to either turn around negative or speed up positive developments in the EU\'s neighborhood. Even if the ENCs received a membership perspective, it would be unlikely to push them significantly towards democratic and effective governance as long as there is no endogenously driven process of change. Given the EU\'s preference for stability and state-building, the ENP does not provide an alternative for promoting good governance either. The ENP clearly lacks transformative power and where it might have some domestic impact, it risks consolidating rather than undermining authoritarian regimes by helping to strengthen their capacities for effective governance.

8. Policy Matters But How? Explaining Non-Compliance Dynamics in the EU

Abstract:
The European Union's infringement procedure is highly legalized. Nevertheless, as in other international institutions, non-compliance occurs on a regular basis and its transformation into compliance varies across EU infringement stages and over time. State of the art compliance literature focuses mainly on country-specific explanations, such as power, capacity, and legitimacy. In particular power-capacity models explain a good part of whether non-compliance occurs and how quickly it can be resolved. Yet, these approaches leave substantial parts of the empirical variation that we observe unexplained. This paper argues that policy and, in particular, rule-specific variables – although often neglected – are important for explaining non-compliance. Based on a quantitative analysis, we show that policy matters not only for the frequency with which EU law is violated, but also the persistence of non-compliance over time and over the different stages of the infringement procedure.

9. Governance with/out Government: False Promises or Flawed Premises?

Abstract:
Governance with/out government has emerged as an alternative or functional equivalent to government. While there seems to be an increasing demand, the promise of governance to compensate for the weakness or failure of government rests on a major premise. Governments have to be strong enough so that non-governmental actors have an incentive to cooperate, and governments are not afraid of being captured. If this premise held, it would result in a serious dilemma for areas of limited statehood: The greater the demand for governance with/out government, the less likely it is to emerge and to be effective, precisely because government is weak.

10. The Transformative Power of Europe Reloaded: The Limits of External Europeanization

Abstract:
With the borders of the European Union (EU) moved eastwards, students of Europeanization have been awarded yet another real-world experiment. This paper explores to what extent existing Europeanization approaches travel beyond the EU's border to its South Eastern and Eastern neighbours, which are marked by “bad governance” with regard to both the effectiveness and democratic legitimacy of their domestic institutions. The first part outlines key insights of the literature on “Europeanization West” regarding the outcomes and the mechanism of the domestic impact of the EU. Then, I summarize the main findings of research on “Europeanization East” focusing on factors that have limited or at least qualified the domestic impact of the EU in the ten Central and Eastern Europe (CEE) countries in comparison to the EU 15 (those that were members before the 2004 enlargement). This paper discusses to what extent the concepts and causal mechanisms need even further qualification when applied to countries, such as the European Neighbourhood Countries (ENC), that are neither willing nor necessarily capable of adapting to Europe and that do not even have the incentive of EU membership to cope with the costs. I will argue that the EU is unlikely to deploy any transformative power in its neighbourhood as long as it does not adjust its “accession tool box” to countries the EU does not want to take on as members. The paper concludes with some considerations on the policy implications of the EU's approach of “move closer but don't touch” which has started to creep into its relations with the Western Balkans and Turkey.
