Abstract:
The European Union, and its Area of Freedom, Security and Justice (AFSJ), is founded on a set of common principles of rule of law, democracy and human rights. This has been officially enshrined in the body of Article 2 of the Treaty on European Union (TEU) which lists "respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights, including the rights of persons belonging to minorities" as the shared values on which the Union is rooted. One of the current modalities of action to ensure that all member states of the EU respect Article 2 TEU is to filter their compliance with these values before they accede to the Union. The so-called 'Copenhagen criteria' have been established in 1993 to ensure that all new EU member states are in line with the Union's common principles before crossing the bridge towards membership.

Abstract:
The EU's capacity for a legitimate, coherent and migrants' rights compliant policy on labour immigration is now more than ever at a test in light of the political priorities set in the EU's 2020 Strategy and the effects of the revolutions and war in North African states during the last four months. This Policy Brief examines the incoherencies characterising the current generation of EU's labour immigration policies and the challenges towards ensuring a global rights-based approach to migration. The analysis carried out in this paper is accompanied by a synthesis of the main policy recommendations discussed at the Workshop on “The Next Phase of EU Labour Immigration Policy: Enhancing Policy Coherence and Advancing a Rights-Based Approach” organised in the context of the Conference “State of the Union: Brussels Think Tank Dialogue 2011” in January 2011.

3. The Place of Religion in European Union Law and Policy: Competing Approaches and Actors inside the European Commission

Abstract:
While the EU has no explicit legal competence in the sphere of religion and the management of relations with faith communities, religious concerns have taken on increasing importance within the legal and institutional framework and policy discourses of the European Union in the last years. This paper provides an overview of how religion and issues of religious diversity are being framed and addressed in EU law and policy by undertaking a critical analysis of the ways in which EU law and policy deal with, engage and understand religion at the policy level of the European Commission. Through an examination of EU legislation and both formal and informal policy initiatives in the fields of citizenship and fundamental rights, non-discrimination, immigration and integration, social inclusion and education and culture, this paper demonstrates that there is a complex and highly heterogeneous patchwork of EU normative approaches delineating the relationship between religion and the EU. These competing framings, very much rooted in the institutional structures of the Commission services, have important implications for discretionary power and sovereignty of the EU member states and for the coherence of European Union policies.

4. Towards a Common European Border Service?

Abstract:
What should be the future institutional configurations of the second generation of the EU's Integrated Border Management strategy for the common external borders? The Stockholm Programme endorsed by the European Council on December 2009 and the European Commission's action plan implementing it published in April 2010 have brought back to the EU policy agenda the feasibility of setting up a European system of border guards as a long-term policy vision. This Working Document examines the origins of this proposal and aims at thinking ahead by asserting that any future discussion and study in this context should be refocused by initially addressing two central questions: First, what kind of 'border guard' and what kinds of 'border controls' does the EU need in light of the current EU acquis on external border crossings and the Schengen Borders Code? Second, what would be the 'added value' of any new institutional arrangement at the current stage of European integration?

Abstract:
The upcoming Swedish presidency of the EU will be in charge of adopting the next multiannual programme on an Area of Freedom, Security and Justice (AFSJ), during its tenure in the second half of 2009. As the successor of the 2004 Hague Programme, it has already been informally baptised as the Stockholm Programme and will present the EU's policy roadmap and legislative timetable over these policies for the next five years. It is therefore a critical time to reflect on the achievements and shortcomings affecting the role that the European Commission's Directorate-General of Justice, Freedom and Security (DG JFS) has played during the last five years in light of the degree of policy convergence achieved so far. This Working Document aims at putting forward a set of policy recommendations for the DG JFS to take into consideration as it develops and consolidates its future policy strategies, while duly ensuring the legitimacy and credibility of the EU's AFSJ within and outside Europe.

6. The Externalisation of the EU's Labour Immigration Policy: Towards mobility or insecurity partnerships?

Abstract:
This paper looks at the dynamics affecting the external dimensions of the EU's labour immigration policy. It assesses the role and functions of mobility partnerships as a mechanism for governing circular migration schemes that allow the temporary movement of individuals for employment purposes between EU member states and non-EU countries. The paper argues that given the actual origins, rationale, conditional nature and kinds of circular migration policies advocated by these partnerships, they should be considered 'security' partnerships for the participating EU member states and to a limited extent for the non-EU countries. At the same time, they could be regarded as 'insecurity' partnerships for the coherency and legitimacy of the EU's labour immigration policy, as well as the liberty and security of the third-country workers.

Abstract:
The European Union needs a new five-year strategy for the development of the next phase of the Area of Freedom, Security and Justice (AFSJ). The existing plan, designed in The Hague Programme of 2004, expires at the end of this year. The Justice and Home Affairs research unit of CEPS has already set out, in several contributions, the big issues and provided policy recommendations for the next five-year plan – The Stockholm Programme – which will be adopted under the Swedish Presidency in December. In June 2009, the European Commission published its perspective towards the Stockholm process in its Communication: “An area of Freedom, Security and Justice serving the citizen: Wider freedom in a safer environment”.3 In this Policy Brief, we take a closer look at the Commission's Communication and highlight the strengths and weaknesses of the approaches adopted for each of the different policy domains falling under the AFSJ rubric. The Communication assesses the AFSJ under three main headings: 1. successes, 2. ambivalent areas and 3. challenges. We will also follow these headings and comment accordingly. Our commentary on the three areas also provides answers to some of the thorny questions raised in the priorities for the Stockholm Programme. We spell these out in the conclusions and put forth a set of policy recommendations.

8. The Commission's New Border Package: Does it take us one step closer to a 'cyber-fortress Europe'?

Abstract:
The European Commission presented a new 'Border Package' on 13 February 2008, setting out its vision of how to foster the further management of the EU's external border. Billed in a Commission press release as a “comprehensive vision for an integrated European border management system for the 21st century”, one of the key elements of this package is a Communication aimed at establishing an EU entry/exit system registering the movement of specific categories of third country nationals at the external borders of the EU. This Communication furthermore recommends the setting up of an Automated Border Control System enabling the automated verification of a traveller's identity (for both citizens and non-EU citizens alike), based on biometric technology as well as an Electronic Travel Authorisation System – abbreviated to ETA – which would oblige non- EU travellers to provide personal data for a pre-departure online check.

The European Interest: Succeeding in the Age of Globalisation, COM(2007) 581 final, Brussels 3.10.2007, which states: “The EU is already working on many of the policy elements needed to equip it to take on the challenge of globalization with confidence…in the coming months, the Commission will be putting new ideas on the table to address these key challenges…Review of internal policies is already under way, aiming to reshape Europe to face gloablisation and give it the right platform to look beyond its borders.” Further the Communication identifies “Migration in a Globalized World” as one of the key political objectives and states: “In a Europe with no internal borders, the changing demands of an ageing society and a labour market in constant evolution have challenged established assumptions about immigration… a new global approach is needed so that migration strikes the right balance between the risk of labour market shortages, economic impacts, negative social consequences, integration policies and external policy objectives”. Abstract:
well before the French Presidency took over the European Council in July 2008, it was well known that immigration was going to constitute one of its central priorities. The French enthusiasm coincided with an increasing interest by Barroso's Commission in this domain. The French government and the European Commission started to fine-tune their respective strategies and 'the way forward' through a series of informal meetings. This materialised in the presentation of two policy outputs: First, a Commission Communication on a Common Immigration Policy for Europe and another on a Policy Plan on Asylum; and second, various drafts of the French Presidency's European Pact on Immigration and Asylum, the latest of which appeared on September 3rd.
