1. The EU and military AI governance: Forging value-based coalitions in an age of strategic competition

Abstract:
The use of Artificial Intelligence (AI) has increased dramatically, driving discussion on the best way to govern it. While much of the discussion has focused on AI in the civilian domain, its usage in military applications raises distinct ethical and legal questions that actors increasingly seek to address. Governance initiatives are becoming more common, even though strategic competition between major powers remains a challenge. The EU navigates this governance landscape more hesitantly than in the civilian domain with its Artificial Intelligence Act (AIA). More information is needed regarding what kind of regulation, and especially with whom the Union could pursue such avenues. This paper seeks to address these questions by presenting and analyzing results from an expert survey conducted in autumn 2023 by researchers at Erasmus University Rotterdam. It argues that the EU needs to pursue a broad range of cooperation formats to advance its values and interests in the context of military AI. Strategic multilateralism is needed, especially with like-minded states that share values with the Union.

Abstract:
Finland will be a member of the UN Human Rights Council, whose task is to promote and protect human rights. The outlook seems gloomy for the upcoming three-year period, with human rights coming under increasing pressure. Finland needs to be active, and to consider taking the lead on the situations in different countries.

3. International Law under Pressure: Continued relevance in times of hardship

Abstract:
The present international political environment is marked by multiple crises, which all have a bearing upon how international law is perceived. Whether one refers to the conflict in Ukraine or to the refugee crisis confronting Europe, there is a widespread sentiment that such events embody a crisis of international law more broadly. This is not just because states have violated their international commitments or been unable to live up to them. A deeper discontent with the international legal system seems to be increasingly prevalent among Western states as well, making international law more of an inconvenience for states than a tool for cooperation. This analysis studies challenging developments vis-à-vis the international legal order and the merits of criticism directed against it by national policymakers. Two main criticisms that have been levelled against international law will be looked into: 1) the law’s inability to take account of national interests; and 2) the law’s inability to reflect new realities. The exploration of these claims and international law’s capability to respond to these concerns will inform the final discussion on whether international law is in a real crisis or not. The analysis will conclude with the finding that the main problems are to be found outside of international law itself; holders of political power should not treat international law as a nuisance, but should manifest their continued commitment to it by operating within the realm of the law and by making use of the tools provided by it in order to deal with contemporary concerns. If states choose to act outside of the law, it will not only undermine international law’s authority, it will also increase uncertainty in international relations.

4. Balancing targeted sanctions: Effectiveness through a climate of legality

Abstract:
Targeted sanctions are political acts that infringe upon the enjoyment of fundamental rights by designated individuals and entities, especially the rights of defence and the right to an effective remedy. Increasing international attention has therefore been paid to the legal implications of targeted sanctions. Targeted sanctions must meet basic standards of fair and clear procedures not only to guarantee the rights of individuals, but also in order to be a credible and effective foreign policy tool. To date, concerns over fair treatment have been addressed in a fragmented and piecemeal way. Judicial review before European courts has provided an important incentive for change, especially for the creation of the office of the UN Ombudsperson. A holistic approach should be developed, which not only emphasizes retrospective review of sanctions, but would also address concerns in the initial phase of their adoption. Increased attention should be paid to the use of confidential information and the right of designated individuals to receive information. Efforts to strengthen legality aspects in the use of targeted sanctions must take account of the circumstances in which these measures are taken. Concerns for international peace and security, and especially for the authority of the Security Council, must be balanced against the protection of fundamental rights.
