Abstract:
In this Discussion Paper, Andrew Duff examines how Russia’s invasion of Ukraine has exposed structural flaws in how the West organises its European defence and how the European Union and NATO have struggled to coordinate, risking duplication and competition. Despite largely overlapping membership, neither organisation has been able to realise conventional solid defence forces. Europe’s armaments industries remain largely fragmented. Ukraine’s application to join the EU and NATO upturns the status quo. The author analyses how the Union's political and financial heft can best be combined with the Atlantic Alliance's military strength and recommends forging a permanent organic link between the two at the executive level. However, a joint command will enhance the EU’s development in security and defence, revitalise NATO, and ensure that the US and UK remain engaged in Europe.

Abstract:
Provoked by Putin, the EU is having to rapidly revise its strategy for the future of Europe. Enlargement, long dormant, is now a top geopolitical priority. Defence has become a principal driver of European integration. This Discussion Paper examines how the two themes of widening and deepening the Union are interconnected. Ursula von der Leyen’s second Commission is preparing pre-enlargement reforms of EU common policies and decision-making processes. Despite disagreements among member states and nationalist political parties, the presumption of enlargement and the necessity of self-defence leaves the EU little choice but to continue on its federative path. No institution will escape the imperative of reform. Negotiations to expand the size and compass of the EU budget will be particularly difficult. Treaty change is inevitable — and should be well prepared by an expert reflection group. Faced with accelerating European unity, the UK will, sooner than expected, have to confront the issue of EU membership.

3. Towards common accord? The European Union contemplates treaty change

Numerous events have conspired to tempt the European Union to reform the way it is governed. Present constitutional arrangements were laid down in the Treaty of Lisbon in 2007 and are long overdue for revision. In recent months, parallel efforts have been made by the European Parliament and European Commission to articulate a prospectus for treaty amendment. The Council remains fearful and inarticulate, divided over the content and timing of any such reform. Andrew Duff returns to the current debate with a Discussion Paper analysing the EU treaty change. He previews emerging proposals from the European Parliament and European Commission, referring to the recent report of the Franco-German experts as well as other relevant contributions.

4. Raising the stakes on constitutional reform: The European Parliament triggers treaty change

Abstract:
The European Parliament, for the first time, has used its powers to trigger a revision of the EU treaties. Its central demand is to change the decision-making procedure behind the passerelle clause from unanimity to qualified majority voting. However, the EU Council has so far refused to submit Parliament’s request to the European Council — in breach of its treaty obligations. At the same time, MEPs continue to develop wider reform proposals to make the government of the EU more robust, decisive, and democratic. With the European Parliamentary elections taking place next year, now is a good time for parliamentarians to take stock of their own performance, review their place in the governing system of the Union, and, other things being equal, prepare for future reform. In this Discussion Paper, Andrew Duff explains that, in an ideal world, more could be achieved under the existing treaties, and the EU could avoid the always complex, often unpopular, and usually protracted task of revising them. With another treaty change on the cards, the Paper analyses the current state of affairs and suggests that the heads of government need the assistance of a reflection group to prepare for a new Convention.

5. Europe after the Brits

Abstract:
Andrew Duff argues that the loss of the United Kingdom should prompt serious reflection about the constitutional direction of the European Union. The secession of a member state changes the context of European integration. Brexit leaves the EU weaker, smaller and poorer — but it can and should also spur reform. The EU should aim to have major changes in place by 2029, including treaty revision. The reforms should include: (i) a renegotiation of the Brexit deal leading to a new class of affiliate membership; (ii) completion of the constitutional framework for a fiscal union; (iii) a European Parliament fully legitimated by election from transnational lists; and (iv) a ‘European Security Council’ of defence ministers to span the divide between the EU and NATO. The Conference on the Future of Europe may prove to be a useful democratic experiment. But it is not designed to address the important constitutional challenges that the Union faces. Duff therefore proposes creating an expert reflection group to stimulate the full implementation of the Treaty of Lisbon as well as prepare the way for the next Convention which must be called to amend the EU treaties. More immediately, the reflection group should make proposals to settle the controversial matter of how to elect the new President of the European Commission in 2024.

6. Dealing with the Neighbours: The case for an affiliate membership of the European Union and a new Security Council

Abstract:
Brexit is proving to be even more troublesome than expected, giving rise to a gradual softening of British public opinion towards the EU. Any future UK government is likely to want to renegotiate parts of the separation deal that Boris Johnson struck with the EU. Reconciliation between Britain and Europe will take time and need careful calibration, however. The EU should prepare for this constructively and use the opportunity of a British renegotiation to review all its other association agreements - none of which are without defect. The question of governance lies at the heart of the problems which impair the EU’s relations with its neighbours. The EEA and Swiss arrangements are in any case due for overhaul and upgrading. The EU’s traditional enlargement policy to the east and south has foundered, and it would be better if this were admitted openly. Not only are candidate countries unable to meet the demands of membership, but the EU itself is too weak to take on the burden of new members. Instead, a new category of affiliate membership should be written into the EU treaties. Affiliation should allow the EU to develop close economic and cultural partnerships with its neighbours in a democratic fashion. Affiliate states would enjoy greater access to the EU institutions than is permitted under any of the current association agreements. Affiliate membership would also be available as an option for any current EU member state which, like the UK, chose not to adhere to the goal of an ever closer union. Such differentiated integration of the wider Europe will require the EU to build stronger federal government at the centre. The new structure should also be underpinned by the establishment of a European Security Council combining EU member and affiliate states with NATO — including Canada and the US — in regular strategic and operational decisions to protect Western security. The French presidency in the first half of 2022 should take the necessary first steps. The Conference on the Future of Europe might consider these proposals.

Abstract:
The EU’s enlargement policy is in contention. President Macron links further progress towards the accession of the Western Balkans to the Union’s own need for internal deepening. Brexit sharpens the debate about the size of the Union and may offer new opportunities, short of membership, for the EU’s wider neighbourhood. The Commission’s proposals to reform the accession process are well meaning but inadequate. The European Council needs to adopt a strategic approach, including spelling out its real intentions with respect to the Balkans. A dynamic association agreement may be a better alternative to full membership for the Western Balkans and Turkey.

8. The European Union makes a new push for democracy

Abstract:
European Union leaders will not be able to dodge the growing constitutional crisis. They are bound to improve the way the Commission president is chosen by reforming the electoral procedure of the European Parliament and by advancing federal political parties. Angela Merkel has dropped her opposition to transnational lists and now agrees with Emmanuel Macron to return to the EU’s institutional agenda. This means treaty change. President von der Leyen promises to help MEPs initiate the reforms and broker the deal in the European Council. Andrew Duff explains what these reforms mean for the balance of power within the Union, and in annexes to this paper, he sets out proposals. He argues that the Conference on the Future of Europe is the right forum to plan how to rectify the weak government of the Union and to strengthen its democratic legitimacy. But he urges swift progress on the related items of Spitzenkandidaten, transnational lists and seat apportionment. Duff favours a direct role for citizens in the work of the Conference, but warns against using this as an excuse for evading tough and complex constitutional questions. The Conference will only succeed if it has a clear and meaningful mandate backed throughout by the three EU institutions.
